Research On The Legal Guarantee For The Implementation Of Ecological Protection Red Line System In Shandong Province

In 2014,the "ecological protection red line" was written into the "Environmental Protection Law",marking that the ecological protection red line was included in the track of legal system construction,and other laws such as the "Solid Waste Pollution Prevention and Control Law" and the "Water Pollution Prevention and Control Law" also stipulate the relevant content of the ecological protection red line.In September 2016,Shandong Province issued the "Shandong Provincial Ecological Protection Redline Planning(2016-2020)",marking the basic completion of the delineation of ecological protection redlines in Shandong Province,and entering the link of system construction and legal protection.In the current delineation and control of ecological protection redlines,local governments have assumed the main role,in order to ensure the legal support for the implementation of ecological protection redlines,Shandong Province should provide a sound local legal guarantee system for the implementation of ecological protection redlines.At the beginning,this paper studies the implementation status of ecological protection redlines in Shandong Province,and compares them with the implementation of ecological protection redlines in other provinces.Based on the current laws and regulations of the country,this paper adopts comparative analysis and empirical analysis.This paper points out that the implementation of the ecological protection red line in Shandong Province lacks special management regulations,the proportion of demarcated area is too low,and the distribution islanding is severe,and proposes that Shandong Province can provide legal guarantees for the implementation of ecological protection red line through local legislation.Specific elements of the legislation should include:(1)Set up a dynamic adjustment mechanism for ecological protection redlines,and clearly stipulate the specific circumstances and procedures for adjustment;(2)Establish a complete ecological protection red line control system,implement classified control,and clarify the subjects and powers of control;(3)Stipulate the responsibility of crossing the red line of ecological protection,improve the result evaluation and behavior evaluation path of administrative entities,and set the most severe punishment method for crossing the line.
