| The right of informed consent of patients is that before treatment doctors should be obtained in patients with fully explained and understood. Implement the right of informed consent of patients can ensure the legitimacy and effectiveness of medical behavior and reduce medical disputes. In addition, it is also the specific reflect of respect for patient autonomy.China’s existing laws and regulations have made a provision on the right of informed consent of patients in different aspects. But because the system is still not perfect, In recent years, the medical disputes caused by the right of informed consent in our country was increasing year by year. At the same time, medical humanities and ethics must be related to the social politics, economy, culture, and law. When the right of informed consent of patients was transplanted into China, China’s unique cultural tradition and the current level of economic and cultural development made it difficult to practice the right of informed consent in our country.Object:This paper analyzed the problems and reasons of patients’ right of informed consent in the law and actual operation. Combining with the case and questionnaire survey, study how to establish relevant system and program execution based on China’s unique cultural background and economic status, so that to perfect Chinese localization of the patients’ informed consent system.Methods:Questionnaire survey randomly selected800people of different ages, gender, region, and culture degree. Questionnaire content includes5aspects:the main body of patients’right of informed consentoperation agreement signed by whoã€appropriate informedNã€how to deal with the informed dissentã€the informing of cancer patient. And each side contains a number of issues.Suggestions:Firstly, patient himself should be the main body of informed consent of patients, but the families can discuss with patients as participants. Secondly, Operation agreement signed by the patient himself. Thirdly, The hospital for patients of so-called "appropriate" told is not a defined standard, the meaning is to say that there are different approaches to tell patients about their condition. At the same time, the focus of inform should not be placed in whether the physician to inform the information detailed enough, but the pursuit of patient and physician discussion and decision making process. Fourth, because the reasons of informed dissent are complex, so the doctor had to make concrete analysis about the reason of informed dissent. It can be divided into general, emergency and mandatory medical activities. Fifth, in the face of cancer patients informed, the right to know should be subject to the right of existence. |
