Migrant workers are the special group in the course of China’s reform and opening up andurbanization, because of historical and practical reasons, migrant workers has been in the city’s edge.The basic rights are not protected. Their legal rights, but in the political, economic, social, cultural andother aspects have been compromised. As economic transform age of the urban and rural areas ofthe emergence of a new type of rural labor force, their prosperity for the city, rural development andmodernization of the state made a great contribution. They are national wealth creators. And becauseunder the existing system of urban-rural dual structure, the social security system and the impact ofdefects in the laws and regulations, making migrant workers in the city in an awkward position of theedge, which as vulnerable groups dissociate in the urban and rural. This is their contribution isextremely disproportionate.This paper analyzes the phenomenon of the rights of migrant workers damaged the status quo,that the rights of migrant workers damaged a number of reasons, first to the household registrationsystem based on urban-rural split system is caused by impaired rights of migrant workers thefundamental system of reason, to change the irrational system.
