Legislative System Of The Local People’s Congresses Budget Supervision

Budget supervision is an important guarantee of the modern democratic system,it is also one of the main functions of the Parliament which the national laws given toit. In China, the National People’s Congress and local people’s Congress at all levelsas a national authority carry this function. In fact, the construction and operation ofany system requires the law to provide a basis protection in the modern country, andall of the operation of power need a legal basis, so the laws need to be complete,detailed and operability. Throughout the development of the budget system relativelywell in some western countries, such as the United Kingdom, the United States,France, are based on the special, comprehensive and specific legislation as asafeguard. However, in china the legal system that the local people’s congressesbudget oversight system running rely on is marginal and thin, not only because thenumber of the laws and regulations is rare, but also the system is not standardized andpoor operability. These are all restricting the implementation of the work of the localpeople’s congresses budget monitoring.The situation that the Legislation of the budget supervision does not match thevalue of the budget monitoring make me thinking how to resolve this contradiction, ibelieve that the most critical thing is to be as soon as possible make further study andimprove the budget monitoring legislative system. For this legislative currentSituation, I wrote this paper. This article is based on this theme, and through combingrelevant domestic and international laws and regulations, made some suggestions andidea, and hope to be beneficial to the legislative system construction of the localpeople’s congresses in china in the future.This paper first describes some of the basic theory of the legislative system ofthe local people’s congresses budget oversight in china, including the history and thedevelopment status.From the relevant laws and regulations which are summarized,we can found the defects and shortcomings of the current legislation system. Then Imake a briefly summarized of the value of the construction of the legislative system of the local people’s congresses budget oversight.In the next part, first i make aintroduce of the legislative system of the National People’s Congress budgetoversight,then through the comparison generalize some useful guidance to furtherimprove of the local people’s congresses budget monitoring legislative. Then i make astudy of the legislative budget oversight of some foreign countries, such as the UnitedStates, the UK, Germany, and Japan, which are most representative. And finally wesummed up some ideas which are benefit to our improve practice of the legislativesystem of the local people’s congresses budget oversight in china.The end part of the paper is mainly give some ideas and suggestions of thefurther improve of the local people’s congresses budget monitoring legislative systemwhich are based on the comprehensive of the legislative experience at home andabroad previously mentioned, this part is also the focus of the full text. The specificconstruction of the system includes two major pieces, the central legislative and thelocal legislation. All of them involve many aspects such as the approval, execution,and the follow-up supervision, and I strive to make It comprehensive and concrete,and hope that this can give some reference value ideas to the legislator about how torevise and improve the budget oversight legislative system of the local people’scongresses in china in the future.
