The Research On The Legal System Of The Compensation For Losses Of The Postal Materials In Universal Postal Service Area

The development of the postal communication has a long history.Theuniversal postal service is a fundamental social public service which plays animportant role in the national economy,social development and the safeguardof the rights of citizens’ fundamental communication.Therefore,the revisionof the postal law gets the most of the attention.The new postal law wasadopted at the8thMeeting of the Standing Committee of the EleventhNational People’s Congress in2009,after the old postal law had been adoptedfor twenty three years later. It has improved a lot on the legislation,comparedwith the old one,especially in the compensation for losses of the postalmaterials.However,as the users,who are the universal postal servicecustomers,have enhanced the awareness of the rights,the postal law also needs further improvement on the compensation for losses.This paper analyzed the different viewpoints regarding the legal basis ofthe compensation for losses of the postal materials in the universal postalservice area,research on determined basis on the liabilities of thecompensation for losses of the postal materials.Then,this paper also analyzedthe reasonable part of it and reasons of the unreasonable parts of thecompensation for losses in practice and in system.Afterwards,it proposes toimprove postal law and auxiliary laws,complete postal materials insurancesystems,perfect the compensatory policies of universal postal service andstrengthen the management of the postal enterprises to improve the legalsystem of the compensation for losses of the postal materials in universalpostal service area,which give a reference to diversify the risk of postalenterprises,protect the users’ legitimate rights and interests,promotedevelopment of postal services and suit the needs of socialist constructionand livelihood of the people.
