Preliminary Research On The Legislation Of Han Chang'an City

Xi’an has witnessed the glorious periods in Zhou,Qin,Han and Tang Dynasty in the Chinese History, which therefore left so many large-scaled sites with deep cultural connotation. In recent years, Xi’an has been in the leading position for the protection of large-scaled sites and gathered some useful experiences. It has been proved that the law has played the important and mandated roles in the protection and management. Taking Han chang’an city sites legislation as the subject, this paper has elaborated the current situation of Han chang’an sites from the angle of public management. Based on the above-mentioned situation, the paper has analyzed the current problems of all related legislation of the nation and Han Chang’an sites.The paper has stipulated related legislation theories, then proposed the necessity and possibility of Han Chang’an sites legislation. Taking some advances and experiences of some international conventions and foreign legislations on sites as well as some provincial laws and rules as references, the paper has put forward the legislation principles and some important specific rules such as administrative agency and its duties, scientific and rational boundary for the Han Chang’an sites,legal status of general planning of as well as its supervisory mechanism, public engagement, expert consultation, legal duties and some related fiscal,land use and cultural industry.the author also want to coordinate some major management relations of Han Chang’an city sites protection and Xi’an urban sustainable development, and also to grip attentions of national Law and cultural heritage community through local legislation on cultural sites.
