The treatment of urban living waste is a worldwide problem. With the development of society, the improvement of the human life and the speed-up of urbanization, rubbish production is increasing. Many cities are trapped into the "junk siege". Wasteful resources and environmental pollution problem caused by the growing garbage, have begun to affect the standard of living of urban residents. Garbage is referred as "misplaced resources ". Solve the garbage problem effectively, improve resource utilization, Japan, Korea and other countries, are dividing and retrieving the municipal solid waste and utilizing it circularly, according to the notion of circular economy. This action achieves a resourceful utilization of municipal solid waste, reduces the amount of garbage disposal. It not only promotes the city’s economic development but also solve the problem of pollution caused by municipal solid waste.From the year of 2008, the government launched a pilot work of municipal solid waste separation and recovery. Firstly the government of china chose Beijing, Shanghai, Nanjing, Hangzhou and other eight cities as municipal solid waste classified recycling pilot cities, then gradually expand the pilot areas. However, the effect of the separation and recovery is not explicit, there are many problems exposed during the process of separation work:For example, residents still will not or do not want to classify garbage; A large amount of sorting work still remains to do; Multiple ways of garbage transportation and multiple ways of incineration still can’t work out.From the beginning of the 1990s, china has developed the law to regulate the problem of municipal solid waste separation and recycling. It is worth mentioning that in recent years, many cities have also promulgated other special regulations and approaches of urban garbage classification and recycle. In our current relevant laws, however, provisions are too principle, supporting laws and regulations are not sound, the rights and obligations set for government, enterprises and citizens are not reasonable and the related legal system is not effective. Because of all this reasons above, separation and recycling of municipal solid waste have no adequate legal protection.There are some successful experiences in municipal solid waste separation and recovery in the foreign countries. They have developed some more comprehensive laws and supporting regulations; Reward and punishment system is set up to reward or punish residents who achieve or fail to classify the garbage; Fixed timing system protects the collection and transportation of garbage which are already classified; Garbage fee system reduces the production of garbage. The system guarantees the classification and circulation of urban living. This article will explore and learn the successful experience from foreign countries. In order to solve the problems in our country, we suggest that we should establish and improve municipal solid waste classification supporting regulations, establish regular fixed system, improve the reward system, establish metering and charging system and establish garbage separation and recycling Instructor System and so on.
