On The Construction Of Public Compensation Fund System For Ecological Damage In China

With the progress and development of science and technology, we have gradually entered the risk society. In the modern risk society, various artificial factors,in addition to natural disasters, that are related to technology may cause ecological damage. Public life is closely related to the ecological damage,which will not only threaten the health of the public life but also affect the harmonious development of society. However, as a result of lacking effective measures of compensation for ecological damage in our country, ecological damage of our country did not receive effective suppression and compensation. Therefore, the establishment of ecological damage compensation fund is the inevitable choice for maintaining public health and creating a harmonious society.This article is mainly divided into four parts:First part, the author makes a basic introduction to the ecological compensation fund. This part firstly introduces the definition and characteristics of the ecological damage. In the risk society, ecological damage has characteristics like wide influence, the potential for a long time, difficult to repair, and hard to make sure the main responsibility. This part secondly analyses and identify the basic definition and function of public compensation fund. Second part, the author analyzes the theoretical basis and necessity and feasibility of establishing ecological damage compensation fund. At present in our country, the establishment of ecological damage is necessary because the most primary ecological damage situation and with the government as the dominant way can not completely solve the problem of ecological damage. Third part, the paper introduces the relevant foreign compensation fund and analyses the management mode, operation procedure and supervision mode of American super fund system. Forth part, this paper attempts to construct ecological damage public compensation fund system according to the situation of our country, and analyses, compares the legal mode and management mode of the fund.With the development of socialization and the growing awareness of citizens, more public and social organizations are needed to participate in solving the problem of ecological damage and relying on administrative leadership to solve the problem of ecological damage will not only increase the administrative burden and affect the government’s supervision service work, but also cause the government credit crisis, and once the cause of credit crisis, the government can not solve social problems that should be solved, and also will lose the support of the people. Based on the comparative analysis, we should take the private corporation mode and the special committee management mode to construct our country public ecological damage compensation fund.
