On The Legal System Construction Of Compensation Fund For Ecological Environmental Damage In China

The ecological environment damage compensation system is still in the process of exploration in China.If the person responsible for the ecological environment damage has the ability to bear the responsibility caused by his behavior,the ecological environment damage can be filled through the system setting of the person responsible for the damage.However,when the responsible person is unable to bear the damage or cannot determine the specific responsible person or even when the responsible person dies,how to relieve the ecological environment damage that has already formed is a problem that needs to be paid attention to and solved at present.Therefore,this paper proposes to build a legal system for the compensation fund for ecological environmental damage,to clarify and try to study the problems in all aspects of the fund,and to enrich relevant theories to solve the problem of non-compensation in the compensation for ecological environmental damage in practice.Therefore,a series of problems,such as whether our country has the conditions to construct this system and how to construct this system,need to be thought deeply,so as to provide the corresponding theoretical basis for the final construction of this system.The discussion on the construction of the ecological environment damage compensation fund originates from the attention to the damage of the ecological environment itself,and its purpose is to improve the relief system of the ecological environment damage in China.On the one hand,it analyzes the current situation of China’s ecological environment damage relief system,environmental protection fund and ecological environment damage compensation system reform.The author believes that China has the necessity and feasibility of building such a system,and it is the best opportunity to build such a system.On the other hand,the practice of the United States,Canada and the global environment fund also provides some useful experience for the system construction of China’s ecological environment damage compensation fund.On this basis,the author think should take the ecological environmental damage compensation law legislation opportunity,have discussed ecological environmental damage compensation fund system,clear funds of public law nature of consortium corporation,the provincial damage compensation fund and national compensation fund combination of double-track operating mode,and from the legal protection,set up the mechanism,operating mechanism and supervision mechanism on system construction in detail.
