| Intangible cultural heritage is an integral part of the cultural chain, reflecting the extraordinary creativity of the Chinese nation, has an irreplaceable cultural and economic value. With the continuous development of society,intangible cultural heritage is being damaged or died.The inheritance of the intangible cultural heritage depends on inheritors’ oral teaching that inspires true understanding within, Inheritors are the core and foundation of the intangible cultural heritage’s sustainable development, shoulder the glorious mission of intangible cultural heritage, and occupy the dominant position of the Intangible Cultural Heritage.This paper will investigate how to protect the rights of intangible cultural heritage’s inheritors from the dominant position of inheritors,divided into five parts.Part 1 introduces the background and significance of the protection of inheritors’ rights of intangible cultural heritage, then introduces the legislation of UNESCO and the research of intangible cultural heritage inheritors at home and abroad, indicating the urgency of the protection of inheritors’ rights. Part 2 clears the dominant position of intangible cultural heritage inheritors. According to the relevant provisions of the intangible cultural heritage inheritors in legislation both at home and abroad, elaborate the definition, types and identification, and analysis the effect and position of inheritors in the inheritance of intangible cultural heritage, and inheritors’ rights and obligations. Part 3 from the current situation of China’s Intangible Cultural Heritage Inheritors, analysis of the main problems of our country in the protection of inheritors’ rights and the causes of these problems. Part 4 discusses the international community’s legislation and practice about intangible cultural heritage inheritors’ rights protection.First introduces the experiences of some international organizations and countries of intangible cultural heritage inheritors’ rights protection, followed by a summary of reference and inspiration to China. Part 5 according to China’s actual situation, proposes six practical measures to give some help to China’s rights protection of intangible cultural heritage inheritors. |
