In a city, the taxi is an important part of public transport, and with the development ofeconomy and the improvement of people’s consumption level, more and more taxis areneeded. But in recent years, taxi strike continuously, has seriously affected the healthydevelopment of the industry. To analyse from the legal level, behind the strike are problemssuch as the limitation of operation right quantity, the chaos of management mode and theinequality of benefit distribution, the reason lies in the lack of the control concept and controlmeasures of the government. The market presence of negative externalities, asymmetricinformation and other defects, to overcome the market failure, we must rely on thegovernment’s "visible hand", therefore, the government to improve the taxi industryregulation even more highlights its importance. As the "springhead" of market regulation,legal research on the taxi market access is the key to solve the problem.In addition to the introduction and conclusion, this paper is divided into five parts:The first part is the case and the question, make Chongqing city taxi strike in2008as anexample, analysis of the causes of the strike, and then put forword the problems in thedevelopment of the taxi industry, as the groundwork for text writting.The second part is the outline of taxi market access system, summarises the connotationand extension of market access system, introduces the history of the taxi market access,analysis the important theory value and the practical significance of the taxi market access,explains the necessity of taxi market access, lay a solid theoretical basis for the next step ofresearch.The third part is the analysis of current situation and problems of taxi market access inChina, this part summarizes the content of taxi market access system for the managementsubject, the main business, business model, quantity control and price control, through theinvestgation of the five aspects, from the outside to the inside, analysis of current problems,in order to put forward the solution.The fourth part is the taxi market access system abroad and its enlightenment, introducesthe successful case and method of taxi market regulation in foreigh countries, combined withChina’s national conditions, selectively puts forward some enlightenment to improve themarket access system in china. The fifth part is the suggestions to improve the taxi market access system in China, basedon the investigation of current situation and the analysis of problems, put forwardcountermeasures and suggestions to improve the taxi market access system in China from thelegal level, and strive to establish a set of perfect taxi market access legal system.
