Fairness in college enrollment is an important part of the education fair. Now, thedevelopment of society is fast, science and technology are also changing rapidly,so thedemand for higher education is more and more high, the fairness of higher education isincreasingly apparent, has increasingly become the focus of attention. Chinese highereducation resources are relatively scarce, it is difficult to achieve universal in short term. sothe right to education of citizens set a certain limit, only to meet certain conditions beforethey can enjoy civic education resources, at this stage mainly through college enrollment andadmission. but this condition should be applied equally to all citizens, must be fair, open, fairand consistent, if there is a difference,it must be legitimate and reasonable.Currently, in the college enrollment process, the problem of right to equal education hasalways been repeatedly mentioned by the media.Many members of the two sessions proposeto reform scheme about the college entrance examination enrollment. Key universities aredistributed all over the country, but due to the combined effect of various factors, theyproduce a lot of problems, mainly as follows::the provincial unbalanced allocation;the keyuniversities enrollment localization;and the resulting migration. Key colleges and universitiesas public resources, should be served to all the students, not to a province or a few provinces.But the provincial quota allocation in reality is so unreasonable, which naturally causedwidespread concern in the community.Most of the laws and regulations related to the college entrance examination are general,temporary and regional. The operability is not strong, can not play its role fully in the reformpractice. It is lack of a unified law in terms of enrollment and admission. The provinces haveto develop different admissions standards according to their free will, in this case, achievingto equality in higher education across the country is Arabian Nights. Therefore, I choose tostudy the college entrance examination enrollment quota allocation system from the educationright protection, analyzes some problems existing in university enrollment quota allocationsystem, puts forward some relevant suggestions, in order to protect the equal rights of highereducation. The text is divided into four parts: the first part is the explanation of enrollmentquota allocation system, connotation, including university enrollment quota allocationsystem history, the existence reason and rationality; the second part is the constitutional interpretation of the equal right to education, including equal rights, educational rights,equal rights to education and related laws and regulations;third describes the current systemof university enrollment quota allocation infringed the citizen’s equal right to education; thefourth part in view of the current university enrollment quota allocation system problems andgives some legal and policy suggestions.Of course, due to various reasons,such as the stock of knowledge, material collectionand poor social experience, researching and thinking about college admissions quotaallocation system in China is still relatively simple, more efforts are needed in the future.
