Maternity insurance, in women who have children and work temporarilyinterrupted when the state and society to give a social security system toprotect their lives and material assistance through national legislation.China’s current system of maternity insurance covers only working thecrowd, ignoring the large number of non-workers women maternityinsurance benefits, to some extent violated citizens equal access tosocial security. The state respects and safeguards human rights, civilrights should be guaranteed the inviolability of giving equal rights to socialsecurity of citizens; paid administrative theory from the social securitysystem, which requires the State to protect the rights of all citizens, givingequal rights to subsistence and development of citizens. I believe thatmaternity insurance to meet the conditions given above theoreticalequality of civil rights, should not exclude non-employees and coversonly employees. Therefore, this article tries to learn from the advancedexperience of foreign and domestic practices in pilot provinces and cities,in the protection of the principle of fairness, the adjustment mode existingmaternity insurance system, the reform of the scope of protection and thecollection model to improve maternity insurance benefits, reduce unfairbecause these systems treatment gap brought about in order to achieve a relatively fair maternity insurance rights.In this paper, the inner logically divided into four parts. The first part of thenon-maternity insurance status of women workers elaborate. Define theconcept of female non-workers, introduces the meaning and maternityinsurance maternity insurance system in our development process, andthen analyzes the status and problems of maternity insurance system.One of the most prominent problem is the large number of non-workersignored the issue of women not be covered by maternity insurancesystem.The second part of Germany, Switzerland, Finland, Japan and othercountries, as well as Taiwan, China, for example, the introduction of fourareas outside the maternity insurance maternity insurance coverage,treatment standards, legislation and management, and maternityinsurance protection legislation with the purpose of practices. Trying tolearn from the experience of exploring a more reasonable outside thematernity insurance system.The third part mainly contains non-maternity insurance system should bea legal analysis of female workers. Protection of civil rights along theConstitution, women as a non-citizen workers deserve the idea of civil rights, equality for analysis from the right to social security andbenefits administration theoretical aspects, whether derived based on theprinciple of equal protection, or based on citizens’ rights to subsistenceand the right to development, women have benefited from the non-qualified workers, should be covered by maternity insurance.The fourth part presents how to reform the situation in China and theconstruction of maternity insurance system of thought. Under theguidance of the principles of fairness and to protect the principle of equalrights and obligations, from the development of a unified nationalmaternity insurance law, the legislative level to improve maternityinsurance; expand the coverage of maternity insurance; reform maternityinsurance payment mode; improve maternity insurance benefits; reformmaternity insurance benefits paid model in five areas of reform andmaternity insurance. The non-inclusion of women workers proposedmaternity insurance coverage feasible solutions, while optimizing existingpayment models and standards of treatment in order to achieve a morereasonable social security. Finally, the article raised prospects of China’ssocial insurance system, convinced that non-maternity insurance willcover women workers in the near future.
