Research On The Legal Issues Of China’s International Education Services Trade

On December11,2001, China officially joined the world trade organization (WTO). As one of the victory fruits of the Uruguay round negotiations, GATS was hard-won, it plays a pivotal role in international service trade field and brings a far-reaching influence on our country’s law of education services trade. In recent10years, China’s international education service trade developed rapidly and made remarkable achievements, China’s international education service trade law also begin to embrace the world legal system. In this context, based on the law of GATS, the author discusses the legal issues of our country’s international education service trade.This dissertation uses countermeasures analysis, empirical analysis and comparison analysis to research the legal problems of the international education service trade. Except the introduction, this disserstation is divided into four parts. In the first part, the author discusses the basic legal issues of the international education service trade. The second part, the author analyses the present situation of trade in services, and emphatically analyzes the legal education service trade in China’s current international legal problems. Such as legal existence blank, the domestic laws and the international laws conflict, supervision mechanism is not reasonable, etc. The third part, the author evaluates the United States, European Union, Australia and other countries or regions on the international education service trade law, and based on this, summarizes what can be used for reference to our country. The fourth part, the author puts forward legal countermeasures to the international education service trade.
