Compared to the previous company engaged in logistics, The TPL notonly has the specific aim, the lower operating cost, but also mentioned a new level ofthe efficiency. And reflects the very good detailed division of labor in modern society,also complies with the development of logistics industry today’s direction, but the TPLindustry is still in the initial stage of supervision, and legal system urgently need toestablish.In September2014, they issued "the logistics industry development planning from2014to2020", the State Council said: the attitude of the need to strengthen thesupervision on safety, strengthen the management of logistics market and make the legalsystem perfect. Our country to the TPL supervision still exist problems such as laggedlegislation even blank, logistics basic law vacancy and the supervision system is notreally established, with no good conflict resolution mechanism, leading to the thirdparty logistics supervision difficult to synchronize with the rapid development of thethird party logistics, has many problems, the urgent need to strengthen the legalregulation.This paper first introduces the background and significance of the legal problemsin the regulation of the TPL in our country. And then, it analyzes the basic theory of theTPL. In addition, by analyzing the present situation of the TPL description, cause aboutthe improvement of the regulations of the supervision and management issues. At thesame time from logistics supervision theory to analyze the feasibility and necessity ofthe establishment of the third party logistics supervision system, USA and Japan on TPL supervision are compared and analyzed. On the basis of this finding is worth to drawlessons from the advanced experience and practice. Finally, from the macro and microperspective respectively to establish the supervision system of the TPL in China:problems carries on the profound analysis, at the same time to improve the TPLsupervision legal problem put forward reasonable suggestions.
