In order to further regulate the development of the Independent Institute, the Ministry of Education issued Decree No.26 in April 2008.The Decree No.26 stands for "independent college setting and management". In this Act, the Ministry of Education for the first time provides for the establishment of an Independent Institute of standards, management mechanism. According to the Ministry of Education requirements, within five years, the country’s Independent Institutes have related work, including the completion of transfer of property rights; the area meeting the standard, the organizers qualification. Meanwhile, Independent Institutes must accept the investigation, embarked on the road to independence. However, by April 2013, five-year transition period dead lined. Only 23 Independent Institutes successful turn to be private colleges in 315 Independent Institutes. Because of this truth, the Ministry of Education had to postpone the examination period to 2016. Therefore, this paper has a research on the "independent" dilemma and solutions of Independent Institute.The first chapter describes the meaning of the Independent Institute, and then sorts out the development process of the Independent Institute, analyzes its current legal status.The second chapter discusses the specific difficulties faced by the Independent Institute on the road to independence, including the school principal, area, property transfer and intangible assets. Subsequently, the article analyzes the "independent" dilemma of the Independent Institutes in Jiangxi Province into by case analysis. Finally, the article analyzes the causes of the current system of Independent Institute facing "independent" dilemma.The third chapter discusses the legal construction of private higher education abroad, and discusses its enlightenment to China. After that, the article proposes legal countermeasures on "independent" dilemma of Independent Institute.
