Collective bargaining system has been systemic promoted in China for nearly 20 years, and the theoretical research has been in the follow up. From the official figures released by the yearbook of labor union and the statistical data published by the national ministry of human resources and social security, collective bargaining system has been carried out smoothly. The rate of signed collective contracts reached targets,and it indicated that regulation and guidance of the laws play an efficient role.However, in fact, in recent years labor mass incidents because of the contradiction between labor and employer frequently occurrence. And the labor mass incidents have a growing trend. So the effect of collective bargaining system has been widely questioned. In this paper, in the perspective of legal regulations of collective bargaining or collective contract from central and local governments, an empirical research will be conducted to rethink the collective bargaining system play a role,combined with the data of the labor mass incidents. On the basis of the statistical data from the empirical research, We can draw the conclusion that there are three problems in our legal regulations. The first one is a large part of the local legal regulations are copied from the central government. The second one is the focus of legal regulations doesn’t match the real bone of contention. The third one is the legal regulationsthemselves are confused, laggard and lack of innovation. Hope this research can help labor, employer and the government to systematically master the problems existing in the process of promoting the collective bargaining system, collective contract and the wages collective bargaining system, thus they will take targeted measures to perfect the rules.
