Study On Legal Problems About National Basketball Association Player Uniform Contract

Sixty-five years has passed since the foundation of National Basketball Association (NBA), which becomes the most successful sports league in USA and world. A uniform player contract has to be signed by the player and the club before the player officially becomes a member of NBA. The termed uniform player contract is one part of Collective Bargaining Agreement signed by NBA player association which represents the benefits of players and NBA league which represents the benefits of clubs. This comprehensive contract is a result of the game between players and clubs during the decades'development of NBA.The content of uniform player contract is negotiated by the NBA player union and the league. Afterwards, the only choice left for the players and clubs is to agree or not, which indicates that this contract is pre-negotiated and therefore termed as the uniform contract. According to the contract, the player is obligated to join the league game for the club and contribute high quality performance, which is essentially a trade of labor. The club is obligated to pay the player, which is essentially remuneration. Therefore the uniform player contract is a labor contractThe thesis focuses on the legal issues involved in the uniform player contract and studies the rights and obligations for the both sides. The research will try to find out the advantages and disadvantages of this system by investigating the procedures such as waiver,arbitration. Chinese Basketball Association (CBA) is relatively young compared to NBA. The investigation on the uniform player contract of NBA and the related system may be useful for the development of CBA in our own country.
