Study On The Public Participation System Of Environmental Protection In China

The article study on the related problems of public participation system of environmental protection in China based on the PX series events in China in recent years.In order to ensure the effective realization of public participation in the environment,the author believes that as a legal system should cover all areas involving public environmental rights and interests,including participation in environmental legislation,law enforcement,judicial,formulation of environmental policy,specific environmental project construction administrative approval,the supervision of government behavior,environmental protection publicity and education and other environmental-related areas.The theory of citizen’s environmental right and the theory of public trust constitute the foundation of the public participation system of environmental protection,The importance of national environmental protection work and the improvement of citizen’s environmental awareness are the realistic foundation of the system,Based on these two basics,the article starting from the reality of the system in our country,Including the legislative status of the system,the national environmental protection policy,civil environmental protection awareness and public environmental protection practice,on the basis of the analysis of the existing problems of the system,and put forward the proposal to improve the system.Respectively,from the following aspects: first of all,in the legislation,establishing the environmental right of citizen clear source of the rights of the public participation in environmental protection,to broaden the scope of public participation in environmental protection,a clear way,form,and increase of encourages and supports the terms of the non-governmental organization of environmental protection,to strengthen the construction of public participation in environmental legislation procedure;Second,to further improve the environmental information disclosure system,expand the scope of information disclosure,improve the accountability system;Thirdly,to strengthen the environmental administrative decision-making and public participation in environmental law enforcement;Finally,strengthen the judicial perfection,including the expansion of the subject of environmental public interest litigation,to further promote the trial open,improve the people jury system,the establishment of environmental public interest litigation system of executive trustee and the evaluation mechanism of ecological restoration effect.
