Research On Plaintiff Qualification Of Procuratorial Organ In Environmental Administrative Public Interest Litigation

In judicial field,with a new round of deepening reform,China’s Supreme Procuratorate issued Pilot Program of Environmental Public Interest Litigation,which focus on implementing the demands of exploring and establishing a system that procuratorial organs involving in public interest litigation field in the Fourth Plenary Session of the Eighteenth Central Committee of the Chinese Communist Party.With the pilot initiative phased in 13 provinces and cities,we can easily find that the new round of pilot reform made a great progress in public environment profits.Furthermore,this paper found that procuratorial organ acting environmental administrative public interest is feasible.At last,according to the pilot situation,this paper put forward advices on improving environmental administrative public interest.In such background,this paper analyzes accuser role of procuratorial organs in environmental administration public service lawsuit.At frist,this paper make a brief introduction to environmental administration public service lawsuit,especially it’s concept,features and difference between other administrative lawsuit.Second,this paper analyzes the necessity to gift the accuser role to procuratorial organs.Third,this paper analyzes the feasibility of procuratorial organs playing the accuser role in environmental administration public service lawsuit in piolt stage.At last,this paper put forward an idea that gifts the procuratorial organs’ accuser role in environmental administration public service lawsuit.This paper is developed around the line of what,why and how.Procuratorial organs’ accuser role is the core of environmental administration public service lawsuit,so,gifting procuratorial organs’ accuser role is the basis of developing environmental administration public service lawsuit put forward by procuratorial organs througout our country.From the above,this paper attains some sucess in exploring formualting regulations.
