Study On The Legal System Of Wetland Protection In Xiongan New Area

Forests,oceans and wetlands are also called the three most important ecological resources on the planet.As a scarce ecosystem,they are the transitional zones between lakes and land.They have huge ecological and economic values.With the increasing awareness of wetland protection,the process of wetland protection has been greatly improved in recent years.But ecological protection as a cyclical activity,historical legacy problems and production and living habits will affect the wetland protection process to a certain extent.This leads to a sharp decline in the area of wetland and the loss of wetland function in history,which has been a problem that must be taken into consideration in the current wetland ecological legislation.The wetland area dominated by Baiyangdian in the Xiong an new area is located in the North China Plain,which is a monsoon climate with unique geographical conditions.But with the increase of economic development and population,the wetland resources have caused serious disturbances from human activities,rivers,marshes were excessive development,many rivers are polluted,diversion,many small lakes and even dried up,the wetland ecological environment is seriously damaged.The main research path of this paper is based on the present situation of wetland protection in Xiong an new area,focusing on the necessity and feasibility of the wetland legislation in the new area.By drawing on the advanced experience of wetland Convention and advanced countries in the area of regional wetland legislation,we put forward a new idea for building the legal system of wetland protection in Xiongan new area.This article is divided into four parts to analyze the wetland protection system in the Xiongan new area.The first part introduces the ecological problems and legal systems of the wetland protection in the Xiongan new area.Xiongan area of wetland resources in Baiyangdian and its main tributaries to the main downstream,in the industrial and agricultural development in the process of long-term gradual emergence of dry lake wetland sediment number increase,Lake shrinkage,reduction of biodiversity,water pollution and serious ecological problems,the industry and agriculture development is facing serious obstacles.However,with the increasingly serious situation of ecological protection,legislation issues increasingly prominent for wetland ownership division is unknown,wetland management institutions confusion and insufficient financial support,lack of relevant agencies inspection,resulting in a "loss of existing standard execution,no one to fill the vacancy specification" of the consequences.The dual crisis of ecological environment crisis and legal system defects put forward new development requirements for wetland protection in new area.The second part introduces the necessity and feasibility of the local wetland protection legislation in the Xiongan new area.At the present stage of wetland legislation in our country does not have a system of special legislation,not the essence of the "law",does not meet the requirements of sustainable development,and the wetland ecosystem self repair ability is relatively weak,the establishment of new wetland protection system with the necessity and urgency of the situation there on time the.With the addition of the Thirteenth National People’s Congress of People’s Republic of China "constitutional amendment" by the central,can be seen for the expansion of the local legislative policy,the establishment of wetland protection legal system xiongan District independent legislation has a strong foundation.In addition,the legislative foundation of the current laws and regulations and the improvement of public participation awareness have built up a strong feasibility for the implementation of regional local legislation.The third part mainly introduces the "local wetland legislation system of wetland Convention" at home and abroad in other countries and regions,the "state" of the Convention on wetlands principles,rights and obligations are described,combined with China’s national conditions and regional economic conditions,explore is worthy of reference.For the advanced countries in the US and Japan,the environmental legislation mainly focuses on their superior policies,including administrative licensing access system,accountability system and public evaluation and supervision system.In the international community,small domestic provinces,the construction of this study,through the wetland protection and management mechanism of existing Qucuqujing,strive to develop more suitable for wetland protection area.The fourth part of the new wetland protection of local legislation put forward their own ideas.The former clearly points out that the problem of ecology and system problems of wetland protection area,and the analysis of the "Ramsar Convention" and other domestic and international protection system,combined with the direction of national policy adjustment,this part mainly explains the basic concept of the new choice of local legislation and legislative mode.It is recommended in the "framework of region and legislation",from the clear ownership of wetlands division,establish wetland licensing control system,the establishment of ecological compensation mechanism,improve the level of public participation,improve the supervision and evaluation mechanism,the implementation of legal liability and other aspects,to further improve the wetland protection specialization and standardization,establish a set of effective local wetland protection legal system,and effectively protect the ecological rights and interests of citizens,promote the sustainable development of economy and society.
