On The Drawbacks And Improvements For The Accuracy In Court Interpreting In China

As a professional service,court interpreting is in growing demand.With China’s accession to the WTO and the speeding process of global economic integration,international economic exchanges,foreigners and foreign capitals are now flowing into China,followed by foreign-related disputes,and criminal activities.In the litigation activities,the foreigners also enjoy the right to use their own language,thus the court interpreters serve as a bridge to help solve those disputes in foreign-related affairs.Also,it plays an essential role in safeguarding the rights and interests of the parties,and maintaining the just and fair image of our justice system.As the fundamental principle of court interpretation,its implementation determines the role of court interpretation in judicial trial.Compared with foreign study of the court interpretation,domestic study features short history and incomplete theoretical system.The applying to practice is insufficient yet.This article analyzes this problem and puts forward the suggestion of improving the accuracy of court interpreting in China.This paper consists four parts.The first part compares the situation of theoretical study at home and aboard,and analyzes the drawbacks of domestic court interpreting in terms of accuracy.The second part analyzes the underlying causes of the drawbacks,which lie in legislation,theoretical study conditions and professional ethics and practical guides.The third part discusses the perfection of accuracy in our court interpreting.It starts from institutional development including the judicial system,the examination and qualification system and the national legislation.Then it proposes improving the theoretical study conditions by strengthening the judicial transparency,and carrying out the continuing education for the professionals and technicians,with elaboration of specific measures.Finally,this article interprets and analyzes the court discourses on the trial of “Kuaibo disseminating obscene materials with the purpose of making profits” based on interpreter’s professional ethics and practical guides,while using interpreting skills.The last part summarizes that the perfection of a system is a long process,which requires relevant laws and regulations and joint efforts from all sectors.Before that,theoretical studies and educational inputs are required to drive the process.
