An Analysis For Market Allocation Of Public Resource:the Economic Law Perspective

In recent years,as an important part of the reform of government management system,China's market allocation of public resource reform has been developing consistently and we have made some achievements,although there are several problems in related legislation,which has restricted market allocation largely.Therefore,it is necessary to conduct this research,which has raised the attention of public and the academic community.This article will discuss the market allocation of public resource in the perspective of the economic law.This article aims to identify related reference of public resource allocation and form a basic understanding of public resource allocation with the methodology of literature analysis.In addition,I tried to analysis the related legal issues of market allocation of public resource,especially the connection with economic law;Comparative research would provide experience for the improvement of the economic law in China's mainland by analyzing the public resources allocation situation and the practice of the legal regulation of Germany,Britain and Chinese Hong Kong's;Finally,this article will focus on by using historical analysis research method,through the study of historical improvement of public resource allocation and economic law,the author will further analysis how to regulate the current market-based allocation of public resources with economic law in our country.This article is divided into four main parts except introduction and conclusion:The first part of this article illustrates the connection between the allocation of public resource and economic law.Firstly,the author analyses the theoretical and practical foundation of public resource allocation;Secondly,the relevance between public resource allocation and the regulation of economic law will be stated to clarity that it is necessary regulate market allocation of public resource in the process of economic law reform.In the second part,the author explains the existing problems in the regulation of market allocation of public resource in China from six aspects.In the third part,the author carries out a comparative study of the regulation of public resource allocation between China's mainland and other jurisdictions,which aims to analysis the regulation of allocation of resources in Germany,the United Kingdom and Chinese Hong Kong and,the lessons and experiences of mercerization reform can China's mainland take.In the last part,the author explains the advice to improve economic law in our country to promote the market allocation of public resource.Firstly,the author raises the transformation of legal thought on the foundation of related improvement of regulation above;Secondly,the suggestions for the improvement of relevant laws and regulations will be discussed;In addition,the improvement of regulation system and supervisory system will be analyzed;Finally,the author focuses on the analysis of the role of economic law playing to guarantee the market allocation of public resource allocation.To conclude,this article analyses the current problems in the public resources field in China,through the explanation of public resource allocation process,the fundamental theory and the comparative analysis between China and other jurisdictions.More importantly,with the experience of other jurisdictions,the author illustrates the advice to improve economic law in our country to promote the market allocation of public resource,expecting to achieve the reasonable regulation of the market allocation of public resources.
