Research On Legalization Of The Major Administrative Decisions Of Country Governments

In the administrative activities of the government,the administrative decision-making is the core and key links,and because of the extensive interests of the people involved,the great decision-making has increasingly profound influence,and having attracted extensive attention from all sectors of society.Under the background of the strategy of ruling country by law,the major administrative decision-making under the rule of law becomes an important problem that not allow to ignore.Among them,the major administrative decision-making problems in the field of the county level government is more outstanding.With the development of economic and social,the decision-making is faced with more and more complex environment,the difficult of making important decisions is also increasing,which sets a higher threshold to make major administrative decision-making for the county-level government.However,power abuse,illegal decision,corruption and other issues are not rare in the actual administrative decision-making activities.In order to achieve the county-level governmental major decision-making scientific,democratization and legalization,and to reduce damage to the society by inaccurate administrative order,the government must be clear of decision-making authority,standardize the procedures of making important decisions,and built the whole responsibility mechanism,perfect the supervision system.The government at the county level is the important executor of the various policies on grassroots farmers from party and the state council.The government actions of implementing decisions and promoting the major administrative decision-making under the rule of law have very important significance,whether to build solid government decision-making public opinion foundation,or to ensure whether the government work is completed,or promote the rule of law government construction.The first chapter is the introduction.This part mainly explains the background and significance of the problems,and lists the research results and the related literature on this problem at home and aboard,finally explains this part content,methods and the innovation points in this paper.The second chapter is about the related theory analysis of the county-level governmental major decisions under the rule of law..First,the major decision should be defined,then it should be extended to the meaning of the major decisions under the rule of law and its theoretical basis;Secondly,the article expounds the characteristics of the county's major decisions,the content of the county's major decisions,and promote thegovernment at the county level administrative decision support under the rule of law theory.The third chapter is mainly about major decisions under the rule of law in the two-dimensional structure analysis.First,the "legitimacy" judgment of administrative decision.in the beginning,I expound the administrative decision of designing standard business and administrative solid state;Secondly I summarize the characteristics of the traditional pattern of administrative decision,advantages and changes in China.Second,optimality judgment of the administrative decision.in the first,the reasons for the introduction the optimality judgment is that legality judgment that hard to integrate some angle,it only can grasp from the angle of the optimality;Secondly,the theory of administrative decision optimality judgment is expounded.Based on the common logic structure of public administration "administrative subject—administrative act—administrative procedure—the judicial relief",in the perspective of optimality judgment,the structure of the administrative decision-making can be described as the main body in the administrative decision—administrative decision-making procedures—administrative decision-making supervision.The fourth chapter,an empirical analysis of the county-level governmental major decisions under the rule of law.The existing problems and the achievements of the decision by law in county-level government is mainly analytic target.First of all,through the analysis of general level,the current government at the county-level the reality of the environment of major administrative decision-making is summed up;Secondly,through the questionnaire survey and the non-structured interview to the people of Y county in Jiangxi Province,it concluded the achievements and the existing problems of the county in the major decision democratization and making important decisions at present;Finally,on the basis of research and theory,this paper comprehensively analyzes the problems and causes of the major decision-making rule of the county government in the aspects of subjectivity,rule of law,accountability,and supervision system.The fifth chapter discusses how to construct decision-making rule of the county government mainly from the following several aspects: first,building major decision-making rights rationally under the rule of law structure;Second,completing major decision-making process;Third,holding the major decision-making responsibility;Fourth,the supervision of major policy decisions.Through the analysis of the four levels,this chapter is trying to explore the realization of administrationaccording to laws.The sixth chapter,research conclusions and prospects.
