| Establishing and improving ecological compensation system is an important decision of the Party Central Committee and the State Council,and it has irreplaceable effect in creating our country’s ecological civilization.At present,the fund of the ecological compensation mainly from the vertical transfer payment,the horizontal finance transfer payment is a small fraction of total.However,as an organic component of ecological compensation,transverse eco-compensation has a great equalization effect.It plays an vital role in regulating interest relationship between the districts which have closely ecological relations,internalizing the external effect of ecological protection.Also,it aims at achieving balanced development among different regions and promoting construction of ecological civilization.In general,the range and total amount of transverse eco-compensation is not very big,largely because of inadequate legal mechanisms.The lag and absence in law of this system also led to a number of traps in specific operation.The specific performances are as follows: there are no clear definition of rights and obligations between compensation subjects and objects;there are no special compensation mechanism and standard procedures;lacking scientific and reasonable standards of transfer payment and the way of compensation is unity;lack of security mechanisms for the operation of the system,such as supervisory mechanism,coordinated mechanism,relief approach and reasonable performance evaluation mechanism.Based on the existing practice condition of horizontal ecological compensation,drawing on relatively mature experience of horizontal transfer payment in Germany and combining with our country’s specific national conditions,finally proposes a new way of perfecting the horizontal ecological compensation system in China.The main ways are: improving the legislation of ecological compensation and financial transfer payment;clearing the legal relationship elements of horizontal ecological compensation,including compensating and compensated subjects,compensation object and specific allocation of rights and obligations;establishing a independent and special compensation mechanism and improving the legal procedures of horizontal ecological compensation;formulating scientific compensation criterion and innovating compensation methods;perfecting the relevant supporting guarantee mechanism for the operation of the system,including supervision mechanism of compensation funds,effective coordination mechanism,channel for relief and green GDP performance evaluation mechanism. |
