While my country’s economic development has made great and stable progress,the trend of continuous decline in the quality of the ecological environment has become more and more obvious.Among them,the ecological environment of the basin has gradually been paid more and more attention by the state and society.Due to the complexity and variability of the ecological environment of the river basin,a large amount of human,material and financial resources must be invested in this project.Therefore,it is urgent to further supplement and perfect the watershed ecological compensation system.We can see that when we look at ecological compensation from the perspective of financial sources,the central financial subsidy is the main component,and local governments can only make limited capital investment based on their own financial resources.This ecological compensation method is relatively simple,and it is difficult to accurately and effectively achieve the established watershed management goals.In the concrete practice of watershed management,local governments have tried to carry out horizontal ecological compensation work successively,and achieved some remarkable results.But at the same time,many shortcomings are exposed in the process of basin ecological compensation by means of horizontal transfer payment.This paper aims to provide some suitable and alternative inspiration and practices for the further improvement of the ecological compensation system in the river basin by analyzing the legal issues of the horizontal transfer payment of the river basin ecology in my country.The supporting theory and domestic specific practice provide two research perspectives for the elaboration of the horizontal transfer payment for ecological compensation in the basin.Ecological value theory,public goods theory,etc.,provide a solid theoretical basis for the specific development of this issue;The introduction and analysis of the specific practice of ecological compensation in the Xin’an River Basin will further help us understand the current situation of ecological compensation in the basin.From the perspectives of the central and local levels,it is easier to sort out the content of the horizontal transfer payment of river basin ecological compensation at the current stage of my country’s legal system,and to discuss the existing legal issues such as ambiguous legal definitions of administrative and financial rights,and unclear validity of river basin ecological compensation agreements.Detailed analysis and presentation.By selecting two countries with relatively successful implementation of the horizontal transfer payment of ecological compensation in the river basin,namely Germany and the United States,and carefully analyzing and excavating practical cases,it is concluded that the legislative process of accelerating the horizontal transfer payment of ecological compensation and the construction of ecological compensation fund can be used for reference and revelation.Finally,combined with the problems existing in the specific practice and legal aspects of ecological compensation in my country’s river basins,and absorbing foreign advanced experience and practices,This paper puts forward a series of practical solutions,such as perfecting the legislation of river basin ecological compensation in the horizontal dimension of transfer payment,constructing a complete set of financial transfer payment system step by step,and clearly explaining the effectiveness of river basin ecological compensation agreement,are expected to promote the implementation of the horizontal transfer payment system for watershed ecological compensation in my country.
