Research On The Legal Issues Of Haze Governance

In recent years,China has continually experienced extensive haze pollution,about 25 provinces and 600 millions people were suffered by haze.Haze as the main problem not only affect people’s health but also affect the living environment,cause the intensive attention from people.With the more understanding of haze,control of haze weather pollution has made some progress.However,the current domestic research about haze mainly focus on pollution prevention and control,limiting emissions,etc.Its governance programs are often fragmented,not systematic,and exposed more problems.In view of this,combined with the current situation,the formation of haze governance and relevant foreign pollution experience,including the actual situation of the present stage of our country,hoping to find useful measures for governance haze,make up for the lack of legislation,perfect the legal system of haze prevention.This paper is divided into four parts.The first part introduces the concept and definition of haze,the main composition of haze,the harm to us as well as the necessity of its control.It is pointed out that the difference between fog and haze,the complexity of cause and the interests of haze are needed to the legal intervention;The second part introduces the domestic legislation process,the present situation of atmospheric pollution treatment and its existing shortcomings.It shows that the haze problems are as follows:the idea is lag,the way is single,lack of maneuverability,the main body of responsibility is difficult to clear,atmospheric pollution compensation system is not sound,the monitoring system is not sound,imperfect information disclosure,the development of local prevention of air pollution becomes weak;The third part summarizes the history of foreign governance haze and how to using the worthy experience.It puts forward a specific response to the regulation of coal emission and energy structure,the emission problem of automobile and the public participation;Through the analysis of the above three parts,the fourth part using legal tools to put forward countermeasures.Establish four basic principles of haze governance,adhere to the combination of source control and end control,improve the system of emissions trading and legal liability,expectation through legal tools to solve the problems effectively.
