Research On Environmental Administrative Accountability

The increase of the people’s pursuit of good ecological environment and the contradiction between the frequent environmental problems today is a contradiction that can not be ignored.With the increasingly serious environmental problems,human reason is also constantly questioning the reasons.Among them,the government’s illegal dereliction of duty in environmental protection responsibilities is one of the important reasons.In practice,the government and its staff in the performance of environmental protection duties,inaction,disorderly conduct,interference with environmental law enforcement and other bad phenomena occurred.Therefore,in order to effectively fulfill the responsibility of the government’s environmental protection,the system of environmental administrative accountability arises at the historic moment.However,due to environmental problems has a long time span,affecting a wide range of features,and the relevant legal norms with the present stage of our country about the environmental administrative accountability system lack of people,for the specific content of the environmental administrative accountability there is a deviation in the understanding of the environmental administrative accountability,there are some problems and shortcomings in the in practical application,the system function is not given full play.Since the nineteen Party’s Congress,the requirement of protecting the ecological environment has been raised to a new height.Building beautiful China has become one of the goals of modernization.It has put forward higher request for the government to fulfill the duty of environmental protection strictly.In order to comply with the requirements of this era and give full play to the system function of environmental administrative accountability,this paper analyzes and explores the current environmental accountability system in China,so as to benefit the improvement and development of environmental administrative accountability system.This article from the theoretical basis of environmental administrative accountability,administrative accountability system to the environment are analyzed and discussed.The main content of this paper is divided into the following five aspects: the first chapter is the theoretical interpretation of environmental administrative accountability.First,clarify the concept of administrative accountability,then combine environmental problems with administrative accountability,and introduce the theoretical basis,characteristics and significance of environmental administrative accountability.The second chapter is the basic content and principle of environmental administrative accountability.This paper mainly introduces the basic contents of environmental administrative accountability,and the basic principles that should be followed in carrying out environmental administrative accountability.It provides a basic theoretical paradigm for the specific analysis of the current situation of environmental administrative accountability in China.The third chapter is the analysis of the development and current situation of environmentaladministrative accountability in China.On the basis of summarizing the development of environmental administrative accountability in China,combined with the work of the central environmental protection inspection team,this paper analyzes the basic status of environmental administrative accountability in China at the present stage through specific cases.The fourth chapter is the analysis of the problems existing in the environmental administrative accountability in China.This chapter,combined with the current situation of environmental administrative accountability in our country,points out the existing legal norms,as well as the shortcomings of the accountability subjects,objects,procedures,relief,supervision and other provisions.The fifth chapter puts forward suggestions for improving our environmental administrative accountability.It mainly puts forward our own views on the legal norms of environmental administrative accountability and the deficiencies of system design,in order to explore a set of effective policies to improve and perfect our environmental administrative accountability system.
