Research On Enterprise Environmental Credit Evaluation System

The Enterprise environmental Credit evaluation system is a kind of system in which the Government,enterprises and the public participate in the transformation of environmental management in China.Government environmental authorities,third party evaluation institutions and other specific subjects determine the results of enterprise environmental credit evaluation according to the enterprise Environmental Behavior information,prescribed indicators,methods and procedures and open to the community for public supervision and the application of relevant departments,institutions and organizations.There are three kinds of legal relations in the Enterprise environmental Credit evaluation system in China,including the direct management,macro-control and service relationship between the Environmental Protection Department and the participating enterprises,as well as the cooperative legal relationship between the relevant units implementing the joint disciplinary measures.It also includes a legal relationship between the unit implementing the Joint Disciplinary measure and the participating enterprise,depending on the type of specific measure.Enterprise environmental credit is an important part of China’s Social Credit system,and it is an important way to promote the transformation of China’s environmental management.Also,it is the guarantee of the full implementation of China’s environmental policy and regulations.At the same time,governments at all levels have issued a number of normative documents on the implementation of the enterprise environmental Credit Evaluation system and attach great importance to the development and construction.The provinces and cities have carried out relevant practical exploration at the local level,while the green credit related to the application of evaluation results also has a certain practical basis.However,it can be found that the implementation of the enterprise environmental Credit evaluation system also has some problems.First,in the aspect of subject participation,the implementation of enterprise environmental credit evaluation system lacks the extensive participation of the third party organization and the public,which is not enough to guarantee its credibility and credibility;Secondly,in the evaluation of index setting,the current enterprise environmental Credit Evaluation Index does not highlight the problem of environmental credit and there are cross-related problems among the specific evaluation indicators;Third,in the application of evaluation results,its dynamic management is insufficient,and the practical application is not perfect.To solve the problems existing in the environmental credit evaluation system of enterprises in China,we can do something from the following aspects: First of all,in the evaluation of the subject,we should ensure the participation of third-party evaluation institutions and the public;Secondly,in the evaluation of indicators,we could increase environmental credit and corporate environmental protection legal liability of the relevant provisions,set up both legitimacy and rationality of the evaluation Index system.Finally,in the application of evaluation results,the government should pay attention to the relationships of establishment of enterprises environmental credit evaluation results and green credit,green insurance and green finance and other linkage mechanism.
