Biodiversity is the most concerned environmental issue in the world at present.lt is not only related to the environment,such as ecology and heredity,but also related to society and science.Biodiversity is closely related to daily life and is an indispensable and important component.For a long time,China has been looking for and formulating effective methods to solve environmental problems.The state has not only adopted various environmental protection policies,but also strengthened responsibilities through legislation.However,on the whole,China biodiversity protection system still needs to be further improved and improved.This paper starts with the domestic and foreign research situation,analyzes the research research results of experts at home and abroad,and summarizes the reasons for studying the legal system of biodiversity protection in China.At the same time,based on the existing research results,from the basic connotation of biodiversity,this paper summarizes the different definitions of biodiversity by scholars,discusses the direct,indirect and potential value of biodiversity,and analyzes the guiding principles of biodiversity conservation from the aspects of risk prevention,prudent utilization and comprehensive management.This paper mainly introduces the current situation of biodiversity protection in China,and analyzes the existing problems in the legal system of biodiversity protection in China,from the aspects of property rights system,supervision system,ecological compensation system,monitoring system,fund guarantee system,ecological corridor system and public participation.Based on the introduction of the major international treaties and the current situation of the legal system of biodiversity conservation in other countries.The most important part of this paper is based on the experience of foreign countries combined with China's specific national conditions,put forward Suggestions to improve china's biological diversity protection legal system,clarify the biological resources property rights system,improve the supervision and management system,clear responsibility supervision.We will improve the ecological compensation system,establish and improve the monitoring system and the fund guarantee system,accelerate the construction of the ecological corridor system and improve the public participation system,so as to better protect China's biological diversity while improving various systems.
