A Study On Legal Protection For Heavy Polluted Weather Emergency Mechanism In China

With the rapid development of economy,ecological environment questions in China are increasingly prominent recently.As far as our country is concerned,the frequently occurrence of heavy pollution weather is affected by industrial structure,geographical environment,and meteorological conditions,etc,which causes a huge negative impact on our production and life.For this situation,Guidelines on Advancing the Revision of Emergency Plans for Heavy Pollution Weather,distributed by ministry of Ecological Environment,which demands to revise the contingency plans for heavy pollution weather across the country.Heavy pollution weather has the properties of suddenness,publicity,and perniciousness.In addition,establishing the high-efficient and all-sided emergency mechanism for heavy pollution weather is the purpose and significance of the thesis.This thesis,based on the theories of the government’s environmental responsibility,environmental crisis management and risk prevention,analyzes heavy pollution contingency plans in seventeen provinces,which finally proposes countermeasures for completing the heavy pollution weather’s emergency mechanism in China.Firstly,in the setting of organization institution,heavy pollution weather emergency headquarters are established across the country,however,our institution needs to be refined,especially interprovincial coordination.In the second place,in the system of early warning grading,which has standard but not unified.While improving our capability to issue early warning,we need to issue early warnings hours ahead of the time.Further,we have established emergency response measures in each province,which need to have pertinence,maneuverability and simultaneously consummate the institution andmechanism of multi-participation.Finally,this thesis confirms the legal responsibilities of the parties and completion of supporting system in the prevention of heavy pollution weather.
