In recent years,China's e-commerce has shown a rapid growth momentum.Cross-border e-commerce platform can form a more powerful e-commerce platform,because cross-border e-commerce platform can break through a variety of obstacles,integration of global e-commerce resources.However,cross-border online consumption is also a great risk,and because this risk is cross-border,the amount of consumption is often smaller,and the existence of language barriers,in the event of a dispute,the application of traditional dispute resolution is not only a complex procedures,but also expensive,and Time consuming,so the online dispute settlement mechanism of this convenient and efficient dispute resolution appeared.The new dispute resolution,ODR,combines Internet technology with ADR mechanisms,makes the solution of e-commerce disputes more economical,shortcut and highly active.The online arbitration as the most formal form of online dispute settlement mechanism,has aroused more and more scholars of the study.This paper takes the online arbitration solution of cross-border B2 C e-commerce disputes as the research object,and synthetically uses the methods of comparative analysis,literature analysis and legal hermeneutics,and discusses the system of online dispute resolution,such as EU and the United States,and focuses on the United Nations International Trade(UNCITRAL)Working Group 3 on the topic of ODR research for e-commerce to seek a more economical,more convenient,more efficient and more equitable dispute resolution,but also to promote China's online arbitration To solve the further development of cross-border B2 C disputes to provide some ideas.The first part outlines the status quo of online arbitration to resolve cross-border B2 C e-commerce disputes.This paper introduces the advantages and disadvantages of the current mechanism of e-commerce platform to solve the cross-border B2 C dispute,and then introduces the development of online arbitration system.The second part summarizes some of the legal barriers to the settlement of cross-border e-commerce disputes by online arbitration,as well as the interpretation of the new developments in the UNCITRAL online dispute resolution rules and the understanding of the United Nations Commission on International Trade Law's resolution of these legal barriers.The third part analyzes the relevant laws of China's existing solutions to B2 C e-commerce disputes,and takes the days cat international as an example,and describes the prospect of using online arbitration to solve the dispute on China's e-commerce platform.At the same time,according to China's online solutions to the status quo,to explore China's settlement of cross-border B2 C dispute online development model.The last part of the article is the summary.
