Higher Vocational Students' Right To Study

The right to education is one of the social rights confirmed by the constitution of our country.After repeated argument,the right to study is finally established as an important achievement of the right to receive education.With the development of the economy and the progress of the times,the right to study conditions,one of the three major systems of the right to education,presents different content in different stages of learning.The higher vocational colleges in our country generally take the students' post internship as the concrete implementation measures to implement the education and teaching mode of "combining work with work" through the formulation of talent training program.From the essence and specific content of internship practice,it has become the core content of Higher Vocational Students' right to learn conditions.It should be summed up as one of the sub rights of Higher Vocational Students' right to receive education.The status of implementation of internship in Higher Vocational Colleges in our country at present,support theory is relatively weak;learning conditions and student employment rights and labor rights confusion in practice,guarantee the internship right state payment content system,supervision system is not perfect and so on;at the legislative level also exists for the right policy guidance.On the legal requirements of the vocational college students of color,especially during the internship learning conditions right are not effective maintenance,internship specific interests damaged phenomenon.Therefore,the right of learning conditions for higher vocational students has not been realized.From the right to the protection and relief of rights and the nature of focus,to clarify the higher vocational students' learning conditions right,in order to fully implement the obligations as a state payment rights corresponding to the performance of seeking legal protection mechanism is feasible,through the legal link between administrative contract making framework of rights and obligations,and further to the right is missing or damaged relief to explore the ways of legal level.From the angle of legislative and judicial practice,the right of learning conditions for higher vocational students is effectively maintained.
