Legislative Research On The Prevention And Control Of Soil Pollution In Gansu Province

As the most important survival factor of human beings,soil is not only the foundation of agricultural development,but also the ultimate "camp" of various pollutants.As the link media of various elements of the environment,it occupies an important position in the whole ecological environment protection.In Gansu Province,soil pollution is serious in the process of rapid economic development.In more than 200 pilot projects of soil heavy metal pollution treatment and remediation technology stipulated by the state,the number of Gansu Province accounts for one sixth of the whole country.The state has always attached great importance to the protection of the soil environment,and all provinces and regions have successively issued legislation on the prevention and control of soil pollution to regulate the development of the prevention and control of soil pollution.In order to guide and regulate the orderly progress of the prevention and control of soil pollution in this region,Gansu Province has also issued local government regulations and policy documents on the prevention and control of soil pollution,but due to the lack of experience,the existing soil pollution prevention and control legislation in Gansu Province has some defects,which need to be perfect.Based on the current situation of soil pollution prevention and control legislation in Gansu Province,this paper studies and analyzes the shortcomings of the current legislation in Gansu Province,and puts forward corresponding legislative suggestions by referring to the excellent legislative experience of advanced domestic provinces and combining with the specific situation of soil pollution in Gansu Province,hoping to make some contributions to the legislative work of soil pollution prevention and control in Gansu Province.The first part is to understand and grasp the general situation of soil pollution in Gansu Province,including the basic concept of soil and soil pollution,the characteristics of soil pollution and the status of soil pollution in Gansu Province.The second part is to sort out and find out the legislative status of soil pollution prevention and control in Gansu Province and the defects of the current legislation.Firstly,the relevant laws and regulations of soil pollution prevention and control in Gansu Province are collected and sorted out from the aspects of national legislation and local legislation.Secondly,it analyzes the defects in the local legislation of soil pollution prevention and control in Gansu Province,including the defects in the level of legislative effectiveness and the defects in the legislative content.The third part is to absorb and draw lessons from the legislative experience of soil pollution prevention and control in advanced cities.On the basis of fully understanding of the laws and regulations on soil pollution prevention and control in Guangdong,Fujian,Hubei and other advanced provinces,this paper has some enlightenment on the local legislation of soil pollution prevention and control in Gansu Province,including the adoption of a comprehensive legislative model,the focus on the protection of agricultural land,the definition of the authority of various regulatory departments,the strict accountability mechanism and the protection of information disclosure and public participation.The fourth part is to put forward suggestions for the improvement of soil pollution prevention and control legislation in Gansu Province.It is mainly aimed at the defects in the current situation of soil pollution prevention and control legislation in Gansu Province,combined with the legislative experience of other cities to give some suggestions: first,change the concept of legislation;second,highlight the key areas of legislation;third,improve the basic legal system of soil pollution prevention and control.
