Study On The Law On Supervision Of Ecological Environment Restoration

Ecological environment is a kind of public goods owned by the whole people,which not only has important ecological function,but also has important economic value in the aspects of energy flow,material circulation and information transmission in nature.Since the reform and opening up,China’s economic development has made more brilliant achievements,but with the rapid development of the economy,there have also been serious problems such as ecological destruction and environmental pollution.These ecological problems seriously affect the well-being of the Chinese people and restrict the further development of China’s economy and society.In order to better manage and repair the environment,it is necessary to strengthen the national policy support and the relevant legal system guarantee,and the ecological environment restoration is an important measure to ensure the good ecological environment.At present,the restoration of ecological environment in China is not perfect,there are various problems in the practice of ecological environment restoration,which need to be adjusted and perfected according to practice.In order to ensure the restoration results of ecological environment,We need to supervise the restoration process and after the restoration.This paper starts with the basic concept of ecological environment restoration,the theoretical basis,the proposal of ecological environment restoration supervision,the development and present situation of supervision,and chooses the theory of ecological civilization,environmental justice and state intervention as the theoretical basis of this paper.Then,the problems existing in the supervision of ecological environment restoration in China are discussed in detail,such as the lack of legal and regulatory basis for the supervision of ecological environment restoration,the lack of supervision over the ownership,management and operation of the restoration funds,the lack of supervision over the restoration process and the restoration results,the single subject of supervision,and the lack of public participation.On the basis of the mature experience of Japan,the United States and Germany in the supervision of ecological environment restoration,this paper summarizes the experience enlightenment of establishing and perfecting the laws and regulations of ecological environment restoration supervision,strengthening the supervision of the ownership,management and operation of funds,and expanding public participation.Based on the actual legislation of ecological environment restoration in China,this paper puts forward some suggestions to improve the supervision of ecological environment restoration in China.It is believed that laws and regulations should be established to improve the supervision of ecological environment restoration;to strengthen the supervision of funds from the unified ownership account of funds,the mode of fund management,and the regulation of the operation of funds;to strengthen the supervision of the restoration behavior by supervising the self-repairing behavior of the polluter,the behavior of the third party performing the repair on behalf of the third party,the behavior of paying the fee,the effect of the alternative repair,the inspection and acceptance of the repair process,and to strengthen the supervision of the restoration behavior and the result;to expand the scope of the supervision subject by realizing the internal supervision plus external supervision and the appropriate introduction of the third party participation supervision,such as the environmental protection organization;Expand public participation through public participation in the selection of repair programmes,participation in the implementation of repair programmes,and participation in acceptance results.
