Research On The Legal System Of Supervision Of Funds For Marine Ecological Protection And Restoration In China

The General Secretary Xi Jinping pointed out in the report to the Party’s 20 th National Congress that we need to vigorously develop the marine economy,protect the marine ecological environment,accelerate the construction of a strong marine state.On October31,2020,China promulgated the Measures for the Administration of Funds for Marine Ecological Protection and Restoration,setting up a special transfer payment fund from the central Treasury for Marine Ecological Protection and restoration to be used exclusively for the restoration and improvement of the Marine ecological environment.It also stipulates the establishment of a legal system for monitoring funds for Marine ecological protection and restoration to monitor and supervise the whole process of fund operation.Marine ecological protection and restoration funds refer to the funds allocated by the central finance through the general public budget to support the transfer of common financial authority for Marine ecological protection and restoration,which play an important role in guaranteeing ecological security and have a wide range of ecological benefits.Since the establishment of the Marine ecological protection and restoration fund,the legal system of Marine ecological protection and restoration fund supervision has gradually appeared such as the relevant legislation is not perfect,the regulatory body is not clear,the scope of use is vague,the procedure lacks specific provisions,funds budget performance management regulations and so on.Therefore,it is of great theoretical and practical significance to study the legal system of fund regulation for Marine ecological protection and restoration.The first part is an overview of the legal system of Marine ecological protection and restoration funds supervision.Firstly,it defines the related concepts of Marine ecological protection and restoration funds,and then discusses the related theories of the legal system of Marine ecological protection and restoration funds.Then it points out the function of the legal system of Marine ecological protection and restoration fund supervision.The second part analyzes the legislative status and problems of Marine ecological protection and restoration fund supervision legal system.This chapter firstly expounds the legislation status of the legal system of Marine ecological protection and repair fund supervision,and secondly points out the problems existing in the legal system of Marine ecological protection and repair fund supervision,and the existing legal problems have been deeply studied.The third part combs the legislative experience and enlightenment of the legal system of Marine ecological protection and restoration fund of the United States,Canada and Japan.This chapter provides an in-depth analysis of the legislative experience of the regulatory legal systems for marine ecological protection and restoration funds in the United States,Canada,and Japan.Based on this,it summarizes its inspiration for China,mainly including a sound legislative system,a rigorous regulatory system,and a clear scope of fund utilization.The fourth part,by combing and summarizing the previous three parts and combining with the actual situation of our country,puts forward some suggestions to improve the legal system of Marine ecological protection and repair fund supervision: First,introduce the relevant legislation of Marine ecological protection and repair fund supervision legal system;Second,we should clarify the subject of supervision of funds for Marine ecological protection and restoration.Third,clarify the scope of use of funds for Marine ecological protection and restoration;Fourth,standardize the procedures for approving and allocating funds for Marine ecological protection and restoration;Fifth,improve the marine ecological protection and restoration funds budget performance management regulations.
