Research On The Linking Mechanism Of Ecological Environment Administrative Law Enforcement And Criminal Justice

In recent years,my country’s ecological environment has been deteriorating with economic construction,and the situation of sacrificing the environment for development is still widespread.Environmental pollution accidents have occurred successively in various places,and environmental violations and crimes have shown a high incidence.However,as far as the status quo is concerned,my country’s crackdown on environmental crimes is not effective.Administrative law enforcement and criminal justice,as two means to control environmental crimes,cannot be effectively integrated to combat environmental crimes.One of the important reasons is that the connection path between environmental administrative law enforcement and criminal justice is not smooth.The research on the linkage mechanism of ecological environment administrative law enforcement and criminal justice belongs to the internal cross-research of law discipline,which has unique performance and requirements in the field of law enforcement and judicial practice.This article intends to explore the perfect strategy of linking China’s ecological environment administrative law enforcement and criminal justice from the perspective of convergence and from the perspective of mechanism improvement.The article is divided into four parts: The first part is the research background,research significance and domestic and foreign research of this article.The status quo is elaborated and reviewed;the second part explains the current status of China’s ecological environment administrative law enforcement and criminal justice linkage mechanism from the current regulations and the current status of practice,and explains the guiding theory of ecological environment administrative law enforcement and criminal justice linkage As well as the framework of division of labor;the third part analyzes the problems and causes in the connection between ecological environmental administrative law enforcement and criminal justice.According to the nature of the problem,it is further divided into three aspects: entity,procedure and technology.At the entity level,it discusses the distribution of departmental responsibilities and cases.The three issues of nature identification,administrative punishment and criminal punishment are used together.At the procedural level,two issues are discussed,the mechanism of evidence connection and the rules of mutual recognition of evidence.In the technical level,two issues of the application of information technology sharing platforms and the configuration of information technology are demonstrated;the fourth part combines the above analysis to explore the three aspects of the improvement strategy of the entity,procedure and technology in the connection of ecological environmental administrative law enforcement and criminal justice.In fact,it is necessary to strengthen the linkage of division of labor between departments,establish standards for case identification,and improve the rules for the combined use of administrative and criminal punishments.Procedurally,it is necessary to improve the evidence connection mechanism and improve the two-way transfer mechanism of cases.Technically,it is necessary to strengthen the construction of an information sharing platform and improve the ability of information technology analysis.Through the above analysis and exploration,it is hoped that it will be beneficial to the improvement of the linking mechanism of ecological environmental administrative law enforcement and criminal justice.
