A nature reserve is a land or sea area that is delineated or confirmed by governments at all levels in accordance with the law to implement long-term protection of important natural ecosystems,natural relics,natural landscapes and the natural resources,ecological functions and cultural values??they carry.The top-level design of the natural protection area legislation has been clarified,which has pointed out the direction for the natural protection area legislation in Guizhou Province.Studying the legislation of nature reserves in Guizhou Province will not only help Guizhou Province to establish a nature reserve management system with clear rights and responsibilities and a clear property rights system for natural resource assets,but also help Guizhou Province to improve the ecological compensation mechanism and public participation in nature reserves.At the same time,the legislation of natural protected areas in Guizhou Province also helps to improve the legal system of natural protected areas in my country.Guizhou Province has a good eco-environmental rule of law tradition,and has accumulated certain legislative experience in the construction and management of nature reserves,but there are still many problems.In the management system of the nature reserves in Guizhou Province,there are still problems of multiple management,backward management methods,and lack of co-construction and sharing mechanisms.In terms of the property rights system of natural resource assets in nature reserves,there are problems such as vague definition of property rights,vacant property rights,and imperfect market operation mechanisms.In terms of ecological compensation mechanisms,there are problems such as shortage of compensation funds,single compensation methods,and imperfect compensation supervision systems.In terms of the public participation system,there are problems such as low levels of public participation,lack of autonomy in participation,and lack of participation skills.In order to solve the many problems existing in Guizhou Province’s nature reserves,it is necessary for Guizhou Province to formulate a unified provincial-level "Regulations of Guizhou Province’s Nature Reserves." In view of the national policy support,other provinces’ legislative experience,and Guizhou’s emphasis on ecological and environmental protection,the legislation on nature reserves in Guizhou is feasible.The legislation of Guizhou Province’s natural reserves should first protect the province’s important natural ecosystems,natural relics,natural landscapes and the natural resources,ecological functions and cultural values??they carry as the goal,and to continuously promote the process of ecological civilization construction and economic and social development.Legislative purpose;secondly,in the legislative guiding ideology,Xi Jinping’s thoughts on ecological civilization should be used as the guide,and should not conflict with the higher law,and the legislation should highlight the local characteristics of Guizhou;again,in the basic principles of the law,the principle of ecological priority and green development should be established.Participation principles,risk prevention principles,and ecological integrity protection principles;in addition,legislation must determine the rights and obligations of governments,communities,social organizations,and enterprises;finally,legislation must formulate relevant systems for natural reserves in Guizhou Province.Regarding the management system,it can be improved by setting up a provincial-level unified management agency for protected areas,using big data to participate in the management and protection of nature reserves,and establishing a sound co-construction and sharing mechanism.Regarding the property rights system of natural resource assets in nature reserves,it can be solved by clarifying the property rights of natural resource assets,clarifying the main body of the property rights of natural resource assets,and playing the role of market mechanism.Regarding the ecological compensation mechanism,it can be solved by establishing a diversified fund guarantee mechanism based on financial investment,exploring various forms of ecological compensation models,and improving the ecological compensation regulatory system.In terms of the public participation system,it can be improved by increasing the level of public participation,cultivating the participants of nature reserves,and enhancing public participation willingness and participation skills.
