Legislation On Wetland Conservation In Guizhou Province

Wetland, ocean, and forest were known as the three great ecological systems ofthe earth. Wetland, as the ecosystem which has the most rich biological diversity andhighest ecological functions, was given the title of “kidney of the earth” for its stronghydrological and element circulatory function. At the same time, because of its largefood network and capability of supporting biological diversity, wetland was alsoknown as “bio-supermarkets”. In addition, its rich flora and fauna resources canprovide humans with a lot of raw material and energy and therefore was called“Golden GDP”.Guizhou province owned16,447square kilometers of wetland, which accountedfor9.34per cent of land area in Guizhou province and2.8per cent of total wetlandarea in China. Due to the rapid economic development, deterioration of environmentpollution and people’s lack of awareness about wetland conservation, the currentsituation of wetland protection was worrying people: substantially reduction ofwetland area, significant quality degradation of wetlands, serious damage to wetlandbiodiversity and so on. All of these run counter to the goal of constructing ecologycivilization in Guizhou province and the main strategy of sustainable development inChina.For the purpose of wetland protection, this paper put forward suggestions from alegal point of view to further perfect wetland protection in Guizhou province. Bymaking commentary analyze on related legislative protection of wetland in provincialand municipal regulations, five main problems were found in Guizhou’s wetlandprotection which were the uncertain of legal concept of wetland, single elementprotection mode, lack of specific legislation and confusion of wetland management,incapable at resolve the conflict between life and ecological protection, lenient orunknown about the legal responsibilities of wetland destruction. By combiningpresent wetland protection situation and prospering the necessity and feasibility offormulate wetland protection regulations in Guizhou, this paper constructs the basicframework of the wetland protection regulation in Guizhou province and offers reference for relevant department to develop consistent wetland protection law. Thespecific content includes legislative principles of combing formulate law andcustomary law, taking ecology as priority and overall protection. At the same time,public participation system, license system on developing wetland resources,ecological compensation system and legal responsibility system will be established.By modifying and improving related legal regulations, promoting related supportingmechanism such as coordination mechanism, benefit evaluation mechanism onecological construction and education mechanism, wetland legislative protection inGuizhou will be developed and the harmonious coexistence between human andnature will be realized.
