Study On The Risk And Prevention Of Environmental Administrative Law Enforcement At The Basic Level

In recent years,due to the gradual improvement of the national legal system and the gradual increase in the investigation of administrative faults,grassroots environmental administrative law enforcement personnel are frequently held accountable for their incompetence,negligence of supervision and dereliction of duty.How to avoid the risk of environmental administrative law enforcement to the greatest extent has become an urgent problem for the grass-roots ecological and environmental departments.Based on the review of related literature at home and abroad,will learn about the basic environmental administrative law enforcement of research as a foundation for evaluation,and then,from the perspective of the current status of H city environment law enforcement,combined with the typical cases of other cities in the province,using participant observation,case analysis and empirical research methods,analyzes the influence factors of basic environmental administrative law enforcement risk,so as to find out the risk prevention and control measures.The study found that the law enforcement task of the grassroots ecological and environmental departments is increasing year by year,the most prominent contradiction is the serious shortage of front-line law enforcement personnel.At the same time,there are also serious problems,such as unclear definition of departmental responsibilities,uneven professional competence of law enforcement personnel,wide range of law enforcement targets,and the growing environmental demands of the people.The above factors,to a certain extent,increase the post risk and performance risk of grassroots environmental administrative law enforcement personnel.Combined with the actual work in H City,this paper analyzes the predictable risks and possible risks of grassroots environmental administrative law enforcement from four perspectives,namely,law enforcement,law enforcement subject,law enforcement object and law enforcement environment,and puts forward four targeted prevention and control Suggestions.First,standardize legal procedures,especially laws and regulations enforcement.Second,strengthening the construction of law enforcement bodies,including the establishment of the list of rights and responsibilities,personnel quality improvement and style of work.Third,strengthen the main responsibility of enterprises,make use of environmental grid supervision,do a good job of legal publicity,enhance the deterrence effect of law enforcement;Fourth,we need to balance the interests of multiple entities,including the government,enterprises and the people,protect their environmental rights and interests,and reduce environmental conflicts.Through the study,it is hoped that the environmental administrative law enforcement efficiency of H city can be optimized,and provide reference for the administrative management of grassroots ecological environmental departments in other regions.
