Research On Legal Regulation Of Mobile Medical Service Of Traditional Chinese Medicine

In recent years,the mobile medical service of traditional Chinese medicine(TCM)is developing day by day.The flexible way of looking for a doctor actually reconstructs the TCM medical service mode.At present,the research on mobile medical service mainly stays at the practice,and the discussion on legal regulation is relatively weak.Lacking laws and regulations leads to the potential risks during the operation of mobile medical service.In order to improve the development of mobile medical services of traditional Chinese medicine,alleviate the shortage of primary medical resources,realize the sinking of high-quality medical resources of traditional Chinese medicine,and ensure the medical safety of residents,systematic research on the development status of mobile medical services of traditional Chinese medicine and related legal issues should be carried out timely.On the basis of reviewing the current situation of the legal regulation and practice of traditional Chinese medicine mobile medical service,this paper puts forward some suggestions on the legal regulation of mobile medical service of traditional Chinese medicine.In addition to the introduction and conclusion,this paper is divided into five parts.The first part summarizes the connotation of mobile medical services of traditional Chinese medicine,discusses the value of legal regulation of mobile medical services of traditional Chinese medicine,and summarizes the significance of building a legal system framework to promote the development of mobile medical services of traditional Chinese medicine from multiple dimensions.In the second and third parts of the paper,through the methods of literature analysis and comparative study,this paper sorts out the experience and lessons of mobile medical services in the real world at all times and in all over the world.The second part shows the development of China’s ancient mobile medical services and foreign mobile medical services,and concludes the main reasons for the prosperity and final decline of China’s ancient mobile medical services among the people.Emphasizing the importance of institutional norms for the development and promotion of medical service mode.And we could absorb and learn from the experience of emphasizing industry norms,access conditions,regulatory system and other aspects in foreign mobile medical services.The third part takes "Beijing suburb mountain mobile hospital of traditional Chinese medicine" as an example,analyzes the current situation of the practice of "mobile hospital of traditional Chinese medicine" which is a typical mode of traditional Chinese medicine mobile medical service,summarizes its service process,norms and experience.And than discusses the actual advantages and system limitations in the exploration and practice of traditional Chinese medicine mobile medical service in China.On the basis of grasping the practical experience and institutional experience of mobile medical service in the real world,the fourth part examines the current situation of legal regulation of mobile medical service of traditional Chinese medicine.It points out that in the existing legal system,there are some problems in the mobile medical service of traditional Chinese medicine,such as unclear service orientation,lack of access mechanism,lack of supervision mechanism,and the relief mechanism needs to be supplemented;in addition,there are also some problems closely related to medical service,such as medical insurance convergence and compensation after medical damage identification,which need to be solved.In view of the problems in the fourth part,the fifth part puts forward the corresponding legal regulation suggestions.First of all,we should strengthen the top-level design and get rid of the current legal obstacles.Secondly,it is necessary to establish and improve the industry rules of mobile medical services of traditional Chinese medicine,establish the access standards in line with the actual needs,clarify the drug and medical equipment configuration and management rules,build a three-dimensional service supervision system,and strengthen the punishment of violations.Finally,we should improve the supporting system of mobile medical services of traditional Chinese medicine,such as make corresponding adjustments in medical security system and medical liability insurance system.
