Research On The Legal System Of Nuclear Waste Disposal In My Country

After experiencing the shortage of unrecyclable resources such as oil and coal,our country began to develop new energy resources vigorously,among which the nuclear industry has experienced the most rapid development.With the development of nuclear power industry,people has increasingly become concerned about the ecological environment.Since the 1960 s,the nuclear leakage events around the world has emerged one after another,which aggravated citizens’ concern about nuclear industry,which also lead to the continued maturity of nuclear-related technologies in all countries.Among them,the disposal of nuclear waste is an important part in scientific research of all countries in the world.How to formulate a complete set of laws to regulate the disposal of nuclear waste has also become a major problem for all countries.At present,legal provisions on the disposal of nuclear waste in China are only embodied in the Nuclear Safety,Law of Prevention and Control of Radioactive Contamination and so on.Nevertheless,most of them are in principles and could not provide specific guidance for the safe disposal of nuclear waste.The regulatory institution for nuclear waste disposal is currently dominated by nuclear safety regulators.However,nuclear waste issues also involve transport,disposal,storage and so on,therefore,other departments should also be involved in the regulation of nuclear waste.How to clarify the functions and powers of each department as well as improve the supervision system have also become a big problem.Meanwhile,the law on the disposal of nuclear waste have also encountered problems in the identification of liability for the resulting nuclear damage and the specific amount of compensation to be paid,the setting of permits for nuclear waste and the lack of public engagement in the siting of disposal sites.Therefore,it is very important to analyze the excellent laws and policies of various countries and find out the significance of the ways toimprove our country’s situation.By reference to abundant foreign literatures and domestic monographs,the author analyzes the above questions and then put forward several ways,that is promoting atomic energy legislation,clarifying the distribution of power and responsibility of regulatory agencies,diversifying the regulatory system,introducing state responsibility,improving the nuclear third-party insurance system,establishing a variety of social relief channels,strengthening public engagement in the process of storage and site selection of nuclear waste,and encouraging public to exercise their rights actively,to improve legal system in China about nuclear waste disposal.
