The construction of nuclear safety legal system is the efficient guarantee of the safe and efficient use of nuclear energy and nuclear technology for our country.The law of the People’s Republic of China on the prevention and control of radioactive pollution is basic law of nuclear safety law in our country, in the order shall be formulated by the state council issued a series of administrative rules and regulations in relation to nuclear security form the main part of China’s nuclear safety, by the ministries and the national nuclear safety administration under the state council issued many of the administrative rules on nuclear safety of branches part of nuclear safety legislation in our country, moreover, issued by local organs of state power and the people’s government on nuclear safety of local rules and regulations and the regulations of the local people’s government, as well as the international conventions and bilateral agreements on nuclear safety participated by our country, which is the part of the nuclear safety legal system in our country. These laws, regulations and rules as well as international legal documents on nuclear security complement each other, make China’s nuclear safety legislation to form an organic whole.At present, there are many imperfections in the aspects of nuclear safety legal system in our country. Drawing on the useful experience of international society and the core of advanced countries, based on China’s use of nuclear energy and nuclear technology practice, summarizing the good experience and practices of China’s nuclear energy and nuclear technology, to strengthen and perfect the legal system construction of China’s nuclear safety, are the important topics that the reality gives us.The article expounds the views on the use of nuclear energy and nuclear technology, current situation of legal system construction of China’s nuclear security and necessity to be improved, enlightenment role of the international community and nuclear advanced national nuclear security law construction of our country, and perfect suggestions on perfecting the legal system construction of China’s nuclear safety.
