The Current Situation And Improvement Of The Accountability System For Production Safety Accidents

Production safety accidents refer to an unexpected event that occurs in the production and business operation of a production and business unit,causing injury to personal safety or damage to equipment and facilities,or causing economic losses,resulting in the suspension or termination of the original production and business activities.Responsibility for production safety accidents refers to the relevant departments exercising public management functions,in accordance with the provisions of relevant laws and regulations,to investigate the legal responsibility of the responsible units and responsible personnel for production safety accidents.Since the founding of the People’s Republic of China,the accountability for production safety accidents has gone through three stages: the unit-based accountability model,the administrative accountability model,and the public accountability model,the system of investigating responsibility for production safety accidents is improving day by day.In recent years,the investigation of production safety accidents has emphasized the implementation of "Double investigation in one case" and "Three responsibilities together" in the investigation of accident responsibility,which not only strictly investigates the main responsibility of the enterprise,imposes economic penalties on the responsible units and personnel,but also strictly pursues the responsibility of government departments.Responsible for supervision,disciplinary actions are taken against responsible persons,and criminal responsibilities are strictly investigated for those suspected of breaking the law.By maintaining a high-pressure situation of accountability for accidents,adhering to heavier economic punishment,severe disciplinary punishment,and prudent criminal responsibility,and further urging departments and enterprises at all levels to implement their responsibilities and build a strong safety line of defense,the national production safety situation continued to improve.This paper takes the accident investigation responsibility investigation situation in Yubei District,Chongqing Municipality as an example,sorts out the current situation of the accident responsibility "Three responsibilities together",from the perspective of "Rule of law",analyzes the problems existing in the process of government departments exercising public management power,and put forward suggestions for further improvement measures to guide government departments to scientifically exercise public management functions,and to promote and improve future accident investigations.The theoretical knowledge of accountability for production safety accidents also has certain guiding significance for the investigation of economic,disciplinary and criminal liabilities in accident investigation practice.
