Study On Legal Issues Of Rural Domestic Waste Treatment In China

Rural domestic waste is the focus and difficulty of environmental governance,and it is related to life,health and human settlements.With the development of social economy and the improvement of residents consumption level,the problem of domestic waste has become increasingly serious,and the problem of rural domestic waste has also become prominent.The treatment of rural domestic waste is related to the construction of ecological civilization and the implementation of the rural revitalization strategy.Inadequate treatment of rural domestic waste will not only cause environmental pollution in rural areas and affect rural landscapes,but also pollute soil and water resources,thereby affecting human health.Therefore,it is urgent to study the problem of rural domestic waste management.This article implements the Environmental Democracy Theory,Circular Economy Theory,and Marxist Ecological Theory through the full text.It uses empirical analysis,normative legal analysis,and comparative analysis to study the legal issues in the treatment of domestic waste in Chinese rural areas.There are many problems in the treatment of rural domestic waste: first,the legal system for the treatment of rural domestic waste is not sound,and the special rural domestic waste management laws and regulations are of low rank;second,the effectiveness of law enforcement in the governance process is still insufficient,and the main body of law enforcement is not Clearness,insufficient law enforcement force,and lack of guarantees for law enforcement teams;third,the main body of governance and supervision is chaotic,related systems are imperfect,and public supervision is insufficient;fourth,farmers’ environmental protection awareness is weak,environmental protection publicity and education are lacking,and it is difficult to comply with the law.At the same time,it is pointed out that the main reasons for the above problems are: the influence of the concept of urban-rural dual governance,the lack of attention to environmental rights,the shortage of capital supply and the insufficient effect of village regulations and folk agreements.Afterwards,based on learning advanced foreign governance experience,we put forward a countermeasure that suits Chinese national conditions,that is,urban-rural integration and the protection of environmental rights should be value-oriented,including: First,improve the legal system for rural domestic waste and strengthen local legislation Establish a domestic waste classification system and give full play to the role of village regulations and conventions;second,strengthen the construction of rural domestic waste management and law enforcement,clarify the main body of law enforcement,improve rural environmental protection management institutions,train high-quality environmental law enforcement teams,and improve related hardware facilities Construction;third,improve the rural environmental protection law enforcement and supervision system,implement an information disclosure system,and give full play to the role of public supervision;fourth,attach importance to the education of rural domestic waste management and environmental compliance,and improve farmers’ awareness of environmental protection.
