Research On Legal Liability Of Third Party Treatment Of Environment Pollution

Third-party governance of environmental pollution is an important part of the field of environmental protection,and the third-party governance mechanism of environmental pollution is a governance model that introduces market factors,which can alleviate the increasingly serious environmental pollution problems to a certain extent.Third-party governance of environmental pollution is in the embryonic stage of development in China,which not only requires institutional guarantees at the legal level,but also requires the supervision of the whole process of the government.As far as the current actual situation in China is concerned,the imbalance in the allocation of legal liabilities for third-party governance,the lack of government regulatory responsibilities in third-party governance,and the lack of legal guarantees for the responsibility of third-party governance enterprises are all obstacles to the implementation of legal responsibilities for third-party governance of environmental pollution.The unclear definition of the scope of the responsible entity,the insufficient enforcement power of administrative supervision,and the insufficient ability to deal with the risk of environmental damage compensation are all reasons for the legal liability of third parties affecting the governance of environmental pollution.Through the elaboration of the above problems,the following suggested measures are put forward for the problems existing in the legal liability of third-party governance of environmental pollution in practice.First,clearly divide the responsible subjects for third-party governance of environmental pollution,expand the scope of environmental legal liability subjects,reduce the risks and responsibilities of polluting enterprises in some pollution control enterprises,and determine the status of responsible entities of third-party pollution control enterprises;second,improve the responsibility mechanism for environmental supervision,strengthen the environmental law enforcement of administrative supervision departments,and optimize the supervision and accountability methods for third-party governance.Third,establish a legal guarantee mechanism for third-party governance of corporate responsibility,establish a third-party governance enterprise damage compensation fund,implement an environmental liability insurance system,and standardize the exemption clauses of environmental service contracts.
