Research On The Legalization Of Marine Ecological Environment Governance In The Beibu Gulf Of Guangxi From The Perspective Of Land And Sea Coordination

Marine ecological and environmental governance is an important part of the national ecological and environmental governance system.In the report to the 19 th National Congress of the CPC,it is proposed to "adhere to the overall planning of land and sea,and accelerate the building of a maritime power",indicating that land and sea coordination is the focus of China’s Marine ecological environment construction.The root cause of Marine ecological and environmental problems lies in the land,and the overall management of land and sea ecological environment is an important task of national ecological civilization construction.At present,the practice of Marine ecological environment governance in Guangxi is still faced with problems such as insufficient legal basis,insufficient land and sea overall implementation,and insufficient judicial relief.In addition to the preface and conclusion,the full text is divided into four parts:The first part is the legalization of land and sea governance of Marine ecological environment in Guangxi.First of all,the rationality is proved,from the legal connotation and basis of land and sea coordination,the theory of rule of law and good governance and Xi Jinping’s theory of ecological environment rule of law,it is clear that the rule of law in Guangxi Beibu Gulf Marine ecological environment governance is the only way to good governance.Secondly,the necessity is proved,and the multiple regression analysis method is used to analyze the key governance direction of the Marine ecological environment in the Beibu Gulf of Guangxi.The analysis results show that land-based pollutants have the most significant impact on the Marine ecological environment of the Beibu Gulf in Guangxi.Therefore,the Marine ecological environment governance of Guangxi Beibu Gulf needs to coordinate land and sea,control land-based pollutants in an all-round and multi-angle way,and jointly promote legislation,law enforcement and justice.The second part is the analysis and improvement of the legislation.Guangxi ecological and environmental legislation has not implemented the "land and sea coordination",resulting in the parallel and separation of the two sets of land and sea laws,and the poor connection between the legal systems.To solve on the whole in Guangxi land ecological environment legislation is not cohesion,lack of coordination,to implement the "sea" for Marine ecological legislation new requirements of ecological environment to environmental protection law as the basic law of the ecological environment governance,timely to "sea" thought into the Guangxi zhuang autonomous region Marine environment protection regulations and actively promote local Marine basin legislation.The third part is the analysis and improvement of the Marine ecological environment law enforcement status in the Beibu Gulf of Guangxi.The law enforcement of Marine ecological environment in Guangxi is faced with problems such as the homogenization of central and local power,and the slow progress of establishing comprehensive law enforcement agencies of land and sea ecological environment.In order to implement the requirements of Marine ecological and sea law enforcement proposed by the principle of "Marine and sea overall planning",Guangxi should conduct coordinated law enforcement with the concept of overall governance,clarify the law enforcement boundary between the Coast Guard and ecological environment authorities,and establish a comprehensive law enforcement agency with the coordinated law enforcement mode of river basin,estuary and sea ecological environment.The fourth part,Guangxi Beibu Gulf Marine ecological environment judicial status analysis and improvement.There are difficult problems to start the criminal litigation and civil public interest litigation in Guangxi.Therefore,Guangxi Marine ecological environment criminal proceedings and Marine ecological environment civil public interest litigation to land as a whole,integration of judicial power,through the possibility and feasibility of judicial green channel,improve the Marine ecological environment criminal cohesion procedure,cultivate and strengthen the administrative departments of the ability of evidence,fixed evidence,improve Marine public interest litigation judicial initiative,unobstructed sea public interest litigation case filing channel.
