The Research On Legal Mechanism Of Urban Light Pollution Prevention And Control

The study of light is a sword of Damocles.While contributing to human social economy,science and technology and other fields,it is also endangering human health and survival.As a hotbed of light pollution,Therefore,The urban light pollution have become the number one target for light pollution control.Throughout the global control of urban light pollution,the use of legal means is second to none.To effectively improve the effectiveness of urban light pollution control in China,it is very important to include it in the scope of laws.This not only meets the current practical needs of urban light pollution control,but also the inevitable requirements for the development of China’s environmental legal system.Starting from the existing legal mechanism for the prevention and control of urban light pollution in China,this paper focuses on existing problems,such as legislation,government regulation and public participation.Based on the legal experience in extraterritorial cities such as Europe,the United States,Japan,and South Korea,we should adhere to the principle of green development,prevention and public participation as well as build legal systems such as zoning governance,light environmental standards,and light pollution monitoring,etc.Furthermore,clarify the legal responsibilities of administrative subjects and administrative counterparts are also required.Promulgate special legislation on the prevention and control of urban light pollution and improve the supervision and management system of urban light pollution from the aspects of clarifying the powers and responsibilities of urban light pollution supervision departments,establishing a coordination and linkage mechanism of supervision departments,etc.From clarifying the subjects and matters of public participation,and the way of public participation,we will strengthen the guarantee of public participation,and improve the public participation mechanism for the prevention and control of urban light pollution.Therefore,we will further improve the legal mechanism for the prevention and control of urban light pollution,with a view to making a modest contribution to the prevention and control of urban light pollution,improving the urban light environment,ensuring the health of the living environment,promoting the formation of a conservation society,and ensuring the stability of the ecosystem.
