| As the party of the Paris Agreement,China has committed to an international responsibility to reduce greenhouse gas emissions,such as carbon dioxide.President Xi Jinping promised the international community that China will strive to peak carbon dioxide emissions by 2030 and achieve carbon neutrality by 2060.For this goal,China launches a national carbon emissions trading on the basis of local carbon emissions trading.Because the power generation industry accounts for about 42.5%of the total carbon dioxide emissions of energy activities in the country,so it is a pioneer of the carbon emissions trading market,and it bears arduous responsibilities and obligations.China regards carbon emissions trading as an important starting point for the implementation of the "carbon peak" and "carbon neutrality" goals,which reflects the implementation of the green principles of the Civil Code.At the same time,in order to ensure the ordered progress of national carbon emission trading activities,the Ministry of Ecology and Environment has successively issued a series of departmental regulations such as the Administrative Measures for Carbon Emission Trading(Trial Implementation).It is aimed to stipulate the rights and obligations of enterprises,and encourage enterprises to fulfill their responsibilities for carbon emissions reduction and control,Departmental regulations ensure the long-term and steady development of the carbon trading market,and reduce the total amount of greenhouse gas emissions of China ultimately.This article is divided into four parts to discuss and research.The first part mainly sorts out the relevant legal theories of domestic and foreign literature on carbon emissions rights and enterprises in carbon emissions trading.The second part mainly sorts out the international conventions that provide legal basis for carbon emissions trading,foreign laws and regulations of carbon emissions that influence China’s trade,China’s carbon emission trading laws and regulations,and the promotion of the national carbon trading market.The third part takes China Resources Power enterprises as the research object,which is included in the 2021 national carbon emissions trading market.And it combines with the laws and policy provisions of the national carbon emissions trading,introducing the key points of the compliance process for enterprise,including register and obtain carbon emissions quotas in Wuhan of Hubei Province,calculation and submission of greenhouse gas emissions data reports,the public participation of the Shanghai carbon emissions trading market and settlement and payment of carbon emissions quotas.Then,It collects that enterprise has the problems of inactive carbon market quota trading,failure to fulfill the carbon emissions quota early and insufficient disclosure of carbon emissions information.In accordance with a series of relevant laws and regulations such as the Administrative Measures for Carbon Emission Trading(Trial Implementation)and supporting rules,part Ⅳ puts forward relevant suggestions for enterprises that are included in the national carbon emissions trading market in the future.This part presents suggestions in terms of legal compliance application and operation of the legal process of carbon emission trading,developing national certified voluntary emission reduction projects for carbon sinks,participating in the formulation of carbon emission trading rules and fulfilling environmental information disclosure obligations.In this way,enterprises can have the ability to avoid legal risks in the strategic operation.And it can promote enterprises to assume China’s due greenhouse gas emission reduction obligations in the international community and make the greatest contribution to solving the problem of global warming. |
