Research On The Judicial Collaborative Governance Of The River Basin Environment

To improve the ecological management of the river basin and meet the growing demand for improvement of the living environment,judicial organs should make full use of their fair and just institutional characteristics,play the role of settling disputes and providing efficient legal services for the watershed environmental protection.In an in-depth study on the correct management of water fluids,it is important to maintain stability of water fluids the ecological environment of river basin,ensuring the balanced development of regional economy,green development and constructing a new governance system.It is concluded that the Yangtze River Basin is currently the most studied and concerned by both theoretical and practical circles,and a special protection law has been issued with relatively perfect top-level design.However,there are relatively few relevant studies in other basins,especially in the area of judicial collaborative governance.At present,there are some thorny problems in how to use judicial means to participate in collaborative governance and improve watershed ecological environment.Effective changes need to be made from the aspects of collaborative legislation of watershed,expanding the main body of environmental governance,perfecting the information communication platform of watershed governance,perfecting the specialization of watershed justice and so on.Based on the theoretical basis of collaborative governance of watershed environment,this paper further discusses the relevant concepts of collaborative governance of watershed justice.This paper sorts out the relevant laws and policies of judicial collaborative governance,summarizes the practice mode of local judicial organs exploring collaborative governance in the Yangtze River basin,and analyzes the experience and results of judicial collaborative governance in the Yangtze River basin.Through a series of studies,it is found that there are some problems in the judicial collaborative governance of river basins in China: the disunity of judicial discretion scale,the lack of participation of the main body of judicial collaborative governance,and the low degree of coordination in the settlement of environmental disputes in river basins.Research and analysis of Mississippi and Rhine river basins summarises key successful governance points and summarises a model of interoperable environmental governance in China.According to the liquidity and external characteristics of the ecological environment governance,and face many difficulties such as interest coordination,jurisdiction and execution,put forward the judicial organs in environmental governance functions must be combined with multiple factors to consider,broaden channels of various main body participation in governance and multivariate main body to carry out the depth cooperation,achieve to discuss work.In terms of collaborative legislation for river basins,it is necessary to implement holism,attach importance to cross-regional all-round cooperation,and realize diversified co-governance and in-depth legislation.In the era of big data,using the Internet to build an integrated information communication platform is a necessary condition for efficient governance.Therefore,if judicial organs want to participate in governance and break the phenomenon of "Nine-Dragon water control",they must also use judicial authority to supervise big data information and establish an information platform for public participation in collaborative governance.The environmental governance of river basin is hindered by local protectionism,and improving the specialization of ecological justice in river basin can achieve the balance of judicial governance in different areas of river basin to a certain extent.Basin of complicated cases and improved its diversified dispute resolution and determine the difficulty of judicial responsibility,break through the traditional judicial theory and practice,innovation of environmental disputes case handling,etc.,this a series of Suggestions and countermeasures to help break the plight of river basin ecological environment governance,important ecological corridor and safeguard our water resources.
